Hi Floridayboy,

Yes, you absolutely must file a I-130, and a bunch of other forms as well. Here is the VJ Guide http://www.visajourney.com/content/i130guide2

The reason in part 2 is A. You will be filing a CONCURRENT I-130/I-485 petition. That is the USCIS jargon and there are instructions there for concurrent filers. Good luck.

Just an FYI... you should read and post in this forum: http://www.visajourney.com/forums/forum/130-adjustment-of-status-from-work-student-tourist-visas/ as you are AOSing from an E2 visa. Everyone in that forum file the I-130 like you will and of course other people AOSing from a E2 like you.

Good luck!

Topic moved from AOS from a Family Visa to AOS from Work, Student & Tourist Visa as a more appropriate forum for this discussion.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

If you are the US citizen, then yes. But you will need to copy all the pages of the passport, I believe, to show proof of citizenship without BC.

flboy - You said in your first post that you are the immigrant. Yes, you need your birth certificate, and a translation of it. Please read the instructions carefully. Good luck.

Joint accounts, joint credit cards, joint insurance, taxes that were filed jointly, affidavits from third parties, photos that show the length of your relationship, photos from your marriage..

You can find several lists of what people have sent here on VJ, and the form instructions also list examples. You don't need to pile up with the bona fide marriage proofs when you sent out the AOS, since you can bring more to the interview. You should still submit something in addition to the marriage certificate. Proof of co-mingling of finances is alwas good.
