AOS question

I am getting the NVC paperwork needed so I am et when my NOA2 comes along..

I do have a question about the AOS though..

I am currently unemployed and know that I have to be a sponser still filling out the I-864.. My joint sponser is my mother (whom I live with, she will be counting my stepdads income as well)

does she fill out an I-864 as well or a different form?

when checking the income requirements does the family size for me include my spouse or me alone?

and does the income size for my mom include her, my stepdad and the beneficiary..?

Sorry im just a bit confused, I dont know if im having an information overload.. :/

As you live with her she can file as a household member under you and file an I-864A. She just needs proof of her income and proof that you live together and you are her daughter.

proof im her daughter? such as a birth certificate.. my address is the same on hers for everything of mine.. can she put my stepdads income on there as well?

As you need your step-dad's income I think your mom will have to fill out the I-864. If she completed the I-864A that only allows you to use her income with yours, it does not allow you to use your step-dad's too. Your step-dad would also need to fill out an I-864A, except that I don't think USCIS consider him a "parent". (Although would be great if someone could tell us otherwise!) Therefore your mom needs to complete an I-864 and then your step-dad can fill out an I-864A as her spouse. The household size on your mom's I-864 would be 3, assuming she has no other dependants: herself, her spouse (your step-dad) and the immigrant (your husband). She would only count you as a fourth person if she listed you as a dependant on her tax return.

You fill out I-864 as sponsor.

Mom fills out I-864 and adds s'dad's income as her family member. Her I-864 total is mom + s'dad and must be enough to meet the required amount. S'dad does an I-864A giving mom permission to include his income and gives his pledge to be responsible for the immigrant. Their evidence of income and citizenship has to be included. They don't each have to make over the limit by themselves. It is the total of the household.
