My husband and I are trying to decide whether to stick it out and complete the CR-1 process, knowing that it could mean another 4 or 5 month separation....(UGHHHH :( )....or continue to hope for our K-3 petition approval, which has taken much longer than we expected.

NVC is processing our I-130 very nicely at this time, and I am tempted to give up on the K-3 process altogether, knowing that the CR-1 offers much more.

What I need to know is this: What exactly are the benefits of waiting for the CR-1? Is the AOS process really as difficult as I've heard?

Please-- if there is anyone who has gone with one visa versus the other and could share their experience with me, it would be tremendously appreciated.

If it is already at the NVC then stick it out, you will only wait much longer if you start over on a CR-1, traditionally the K3 is a bit quicker than CR-1. Your petition is past the long part.

Your answers make less sense every time I see them. Sometimes you're spot on, but most of the time not.

This person is ALREADY at the NVC with her CR-1 application.

Reread what you wrote--you confuse and misdirect people.

Tracy it can't hurt to let both ride at the time and make your decision based on which one gets the interview first. One main advantage of going with the CR-1 is the ability to work immediately upon entering the U.S. For some this a deciding factor in itself. If you read some of the posts of people waiting on their AOS and EAD you can see some get very frustrated (especially when it is the husband that cannot work).

07-06 - Moved to Canada (PR almost complete)

07-06 - Changed again, back to US imm.

09-06 - Landed as Canadian PR

Thanks, Married....the working issue is a big factor, although I have a really good job. My husband would go crazy if he was here for months with nothing to do while I'm at work all day. I think it is just a good idea to wait for a while longer to see what happens.

We are desperate to be together again, but still trying to be smart about the whole thing, too.

So Eva...you've ditched the K-3 process? It didn't work out quite like I hoped..or you either, apparently :no:

I know the CR-1 takes a while, but for as much as my husband and I have had to suffer already by being forced to live apart the last 8+ months, we don't want to make our lives any more difficult with the AOS/EAD process once we're finally together again.

God willing, we'll get through the NVC rather smoothly and have something to look forward to soon...

Here's hoping all goes smoothly for you, too :yes:

My husband would go crazy if he was here for months with nothing to do while I'm at work all day.

That was an issue for my husband as well. I think if I was the one who wouldn't have been able to work, it would have been okay and I fully appreciated his feelings on this....

Tracy, why not just let them both ride for a little while, maybe if the K-3 gets approved and you get and interview date, then the I-130 gets completed you can still keep the same interview date rather than them having to set a new one at a later date.

I'm just so torn. I saw the statistics for the average time between NOA2 and the CR-1 Interview for the Embassy in Peru and it is 8 MONTHS!!! That would mean my husband and I would not be together again until April :crying:

I cannot afford to travel back and forth to Peru for visits, so I was planning on just going there for the interview. But if it's not scheduled until April or so -- and we have our K-3 petition approved any time soon -- I don't know what I'll do.

This is torture.

I REALLY need more feedback guys.....PLEASE ADVISE.

Why not let both ride for now. Hopefully the I-129F will be approved soon and will be on its way to the consulate. You do have some leadway with the NVC process for the approved I-130. You can stall the process somewhat...

From my paperwork from NVC,,,,,,,

If a period of one year passes without contacting NVC (by telephone or mail), all submitted fees and documents will expire. In this case, fees and documents will need to be resubmitted in order to continue the Immigration process.

Suggestion.....Stagger the payments and form submissions to take as much time as necessary without falling foul of the above. Keep in mind that the Visa Application (DS-230) is often the last thing filed and once this happens and case complete and forwarded to the consulate that any K-3 visa interview will be cancelled as the CR-1 takes precidence. Once interview for K-3 is held and visa in hand you can then either adjust status in the US from the K-3 (you will lose any moneys already submitted to NVC) or continue with the payment of the IV Bill and Visa Application (DS-230) and return to Peru for the CR-1 interview.
