question 31. have you ever been charged , arrested, or convicted of any offense and crime?

who should say yes here?

getting arrested in USA because of a fight or speeding, or alcohol, but then released free with no charge should say YES?

and if said YES, it will get things slower or no affect?

Anyway they are looking for honesty, just answer the questions honestly, they are looking for violent crimes, if arrested for non-violent crime state it and explain the circumstances.

yeah i think the same but i dont want them to make things take much longer because of a none important , none violent thing. no charge no nothing either.

otherwise dont need to hide anything but gonna have to say yes i guess.

Wrong.

These questions are NOT additions from IMBRA.

They are also not limited to violence only. The question is asked exactly as it is asked. If you have been arrested, even if charges were dropped, claim it and deal with it.

makes sense.

but the question 31 doesnt make one ineligble to be granted a visa. it can only confuse the officer and ask you more question in my opinion.

but the question 30 can make you ineligable , then one should file a waever form and such. this is stated on the form also.

correct me if i am wrong

I thought they run security checks and would be able to dig out that info anyway. I don't know. In case they do run security checks, wouldn't it look bad if you previously stated that you haven't been arrested and they got a hit for when running the security checks? As meauxna said, I think the best thing to do is to be honest.

DS 230 part II has to be filled out by the foreign alien spouse (the beneficiary). So if the beneficiary has ever been arrested, charged, convicted, then the answer should be 'yes.'

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
