My wife and I checked our status on the NVC automated telephone line to see if there had been any progress since our AOS stuff was sent in. It said that we had information missing or incomplete and that a letter was sent out yesterday, we had not recieved anything so soon so decided to phone again and speak to an operator to see what was missing.

My father in law is being a co-sponsor and so we sent in his I-864A with the AOS package. The operator said that we had not enclosed any evidence of the relationship between my wife and (sponsor) and her father (co-sponsor). We were asked to send in a copy of my wifes birth certificate which would obviously display his name. We have already sent in one copy of her birth certificate with the original I-130 package. It is not a problem to send this in but after re-reading through all the I-864 and I-864A instructions again we cannot find anywhere where it states that proof of this relationship is necessary. It's just a bit dissappointing because it feels like an unecessary delay after believing we were very thorough with all of our paperwork.

Has anyone else had this happen?

For the I-864A you must attach proof that that person qualifies as household member (I-864A Instructions pg, 2, part 1, item 8). The BC with the I-130 isn't enough. Need a copy submitted with the 864A.

A household member is someone you filed taxes with, not just a relative. i think you want you father in law to be a co-sponsor, and if this is so, you have used the wrong form. a co sponsor fills the same form i-864 (not i-864 a) and checks the box for co-sponsor.

You do not have to file a joint tax return with, or be claimed as a dependent by, a household member for them to qualify as a household member. The requirements are spelled out in the I-864A instructions. A parent residing in the same house with the petitioner/sponsor does qualify.

I was assuming that the person in question did not live in the same house, sorry for the confusion.
