My wife is in the immigration process and I found out that I can claim her in 2010 Taxes using Form W-7.

If I am to amend my 2010 taxes in 2011 and claim her, will I get rejected?

I don't want to do W-7 because I feel I may miss the Tax deadline.

Can anyone speak from their experience regarding amending taxes?

you can get an extension 6 months to file your taxes, amend,it is better for as being married joint you should get a better tax refund, and if your married you have to file as married, if you , wife in in another country you need the w-7 you both need to sign have it notorized, copy of your us passport bio page,copy of your marriage certificate, sent it to itin operations mail stop 6090-ausc 3651 south intereginal hwy 35 austin tex 78741-0000 ---DO NOT SEND TO ANY OTHER OFFICE,send your tax return file along with the w-7. good luck

First of all if you were married in 2010 you can only file as Married filing jointly, married filing separate or head of household (though many in this forum will tell you it is ok to file single, I beg to differ). Filing single can also have problems during interview. Well to avoid this, I decided to do W7 but didn't have her passport and didn't want to do certified/notarized+appostile so here is what I did and I already have ITIN in almost two weeks and I didn't even use her passport as supporting document.

The only option if you don't want to deal with W7 is to file married filing separately. That way you are not hiding the fact from IRS that you are married and also it won't hurt you in the interview. The only downside is that you may not receive a refund or even owe IRS money but when you file amendment, you will get it back. Filing an extension is a bad idea because if your interview is after April 18th, embassy may hold your visa till your provide them with tax return of 2010.

3/02/11 - DS-3032 : Email accepted

3/04/11 - IV bill invoiced (e-mail at 2:30 AM) and paid

3/07/11 - IV payment status "PAID"

3/08/11 - AOS and IV packet sent

3/22/11 - AOS in the system and reviewed that triggered false RFE for IV packet

3/28/11 - DS-230 in the system and SIF

3/29/11 - Case Completed at NVC

4/13/11 - Interview date assigned

5/17/11 - Interview- Approved

5/18/11 - Passport & Visa Picked up from VFS Delhi

5/31/11 - POE (JFK)
