I wonder if my wife could travel with her maiden name green card with marriage certificate to India and will she have any problem coming from India to USA using greencard and Marriage certificate? She recently changed her maiden name to my last name on her green card and it was lost. She needs to travel to India for business purpose and i was wonder if she will have any problem.

Thank You

Yes the old GC and the marriage certificate should work.

The only concern would be are you sure they have not cancelled her old GC.

If they have cancelled her old GC and when she tries to enter US and screen show cancelled GC it would be pain.

I'm confused. You said your wife's GC is in her maiden name (that's her unmarried name) and then you said she recently tried to change her name on her GC to her married name but she lost it... So, if she sent in an I-90 to change the card she would have sent (or SHOULD have sent) the maiden name greencard with the application... so are you saying she didn't? If she didn't that GC isn't valid, it was supposed to be sent in, she can't use it.

What do you mean by she lost her married name GC? Was it lost in the post? Did she lose it after she got it? If so she'll need to file an i-90 to get a replacement.

Whether she has the maiden name GC (which should have been sent off with the i-90 to change the name and would have no been voided for the married name one) or she doesn't have a GC, she needs to file the I-90 for a replacement of the married name card she lost, then make an INFOPASS appointment when she gets the NOA1 (or before if the flight is soon but with proof of filing) to get an I-551 stamp in her passport (this will allow her to travel and get back in no problem). I would also take the void GC (the maiden name one) to the infopass and ask them what to do with it.

on Dec 2010 my wife filled out I90 form to get her madian name changed on the GC. She went threw the process got her biometric done and 2 months (Feb 2011) she received her GC with her married name. She took that GC to Indian embassy to get her name changed on passport ( Madian to married). she had her greencard with her when she was in the office. when she came home she couldnt find her GC. we looked everywhere for it and still cant find it. She still has her GC with her madian name on it (USCIS never took it)and is still valid. Now she has to travel to India for business purpose in almost 3 weeks april 10. do we need to fill out I90 again and pay for it? I couldnt find I551 form on the USCIS website. any help would be appricated.

thank you

I see. Sorry but the maiden name greencard ISN'T still valid... it was replaced by the married name one and is/was voided. She can't use it, it's nothing more than a decorative card in her wallet (she was supposed to send it with her I-90 when she changed her name, she wasn't supposed to keep it). She needs to file a new I-90, pay for it and when she gets the NOA1 from it she makes an INFOPASS to get the I-551 stamp. There is no form for the stamp, she asks for the stamp at the infopass.

Did she contact the Indian Embassy to see if she left it there?

No problem and thanks for your help. Yep we contacted the Indian Embassy and they didnt find anything, looked all over the house and all the car. still cant find it. I think USCIS should reduce the fee for people who lost their GC. haha

I found it strange that they didnt take the card during her bio metric appointment. My mom still has her old one and USCIS never took that either. the instructions on the form says nothing about returning it.

Do you know if the USCIS office same where you get the bio metric or is it at different location?

You're right, it doesn't mention to include the card.. that's interesting... Maybe then that means the card is okay? I don't know for sure and I certainly wouldn't risk it.

The infopass appointment usually is at the same location as the biometrics but I think a different section of the same office (was for us anyway).

I'd make an infopass appointment and ask if the card in her maiden name is still valid.
