ok heres my deal..

I have 2008 and 2009 on the way, but we havent filed for 2010 yet.

we never filed in 2007 since neither of us had any income.. I moved to the us in September of 07 and wasnt able to work until Feb of 2008..

my wife thought she didnt have to file since she made no income..

was this a mistake?

One of the few breaks offered by the IRS, even if you got married in December 31st of the tax year, can claim that person as a deduction for the full year. Also the best time to have a baby born.

An equally bad thing to do is to get a job before you get your EAD or green card. Ha, my wife wanted to get a job when she first came here, and I said, what, and get deported? Gather she wasn't accustomed to having a man support her and her daughter, use to be a tradition in this country to do so. But it didn't take her long to get use to it, but she went ahead and got a job anyway, after she received her EAD. Said she could do volunteer work, when people learned how good she was, got a nice paying job instantly.

we got married in october and had a child.. I remember doing doing the taxes for 2007 but we never submitted them because there wasnt much of a refund.. Im gonna look more into it. Maybe we did submit it. I tried to order a transcript for it but the system wouldnt let me..

You can mark the N-400 form accordingly, and then answer the I.O.'s question on how you paid your bills and show documentation to that effect. Worst case scenario is that the I.O. gives you an RFE and ask to bring a statement from the IRS that you are on good terms with them and don't owe anything. Not very likely, but possible.

I'd rather fill out an I-1040EZ after work and file it with a bunch of zeros in it. Figure 5 to 10 minutes for that.

i think she may have made $500 that year.. Im gonna get her to look into it.. we didnt have any bills other than a car note and cell phone. which was paid from savings.

I may just wait to file the n-400 and do our 2010 return. as well as the 2007 if we didnt already.

I assume then that the sponsor was not your wife then? I remember that for the affidavit my husband had to show some income in order for me to get the visa.

I would file now (both federal and state tax) and explain to the officer why you didn't file. Make sure you tell him that now you understand that you need to file and you will file from now on :)
