Hi! I am new. I am at the very end of this long process! My step children in Jamaica are living with their auntie because the mother left them un taken care of. so i filed for permanent residence in january. now we are waiting for an apt letter for the children to go to the embassy! So i am scared to death if they want a paternity test. He and the woman were never married but his last name is the same as his children and his name is on the birth certificate. but we went to jamaica in november to fix one of the birth certificates because the child's name was spelled wrong. my husbend has always had a gut feeling one of the children are not his. (his woman turned out to be a bad cheater) so we are scared to death we don't want to find out this way we don't want the child to find out until they get to the united states we will tell her someday. SO MY QUESTION WILL THEY DO A PATERNITY TEST IN MY SITUATION? i had lots of proof, western union receits and stuff like that we support and love them very much.

thankyou so much!!!!! i have been asking and asking that question!!!! and my husbend did not marry his baby mama but his name is on the birth certificates and the children hav his last name ! i have been so nervous because the appointment is coming up and i don't want anymore delays and no more thousand and thousands of dollars to spend! i just want the kids to come and let our family be reunited!

As I stated in your other post the proability is high they wii require a DNA test. What's in bold has no bearing on anything. The embassy is quite aware of the situations reguarding "jacket" proability in Jamaica.

From what I know if a paternity test is requested it will be done at the time of the medical and kids petitioned for via a biological relationship through their fathers have to do it. The thing is there's no way around the test if you are required to do it.

If you:

Have results of paternity test ≠ man filing petition = no visa/greencard

Have results of paternity = man filing petition = visa/greencard

Refuse to do paternity test = no visa/greencard

And if you file for the kids as their step mom you will still have to do a paternity test between your husband and his supposed kids. This is because family based immigration is to reunite blood related family and if the kids aren't his the petition that you have filed becomes void.
