I still think that the K-3 should be removed as a MAJOR forum and put as a smaller subsidiary link under the CR-1 forum (like the "case status & progress reports"). If it becomes clear that the K-3 visa IS viable again, then the forum could be restored to major status. However, I too am sick of reading the same explanations over and over about why the K-3 isn't viable in comparison with the CR-1, etc.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That's a start but people come to VJ with the K3 already in mind based on other sources. Not sure why you're saying the K3 is viable. If even 2% of the people who file an I-129F for a spouse will ever have an opportunity to have their spouse apply for a K3 visa, I might agree it's viable. The percentage is some small fraction of 1% though and the result of some freak accident we can't explain. Do you call that "viable".

The issue here is that the vast majority of threads in the K3 forum either are about why and how the K3 is not a viable option or completely off topic. Those of us in the know, are getting tired of explaining this over and over and over again to each newbie that comes in with a question about how to obtain a visa they, in reality are NOT going to obtain.

A minimal second step would be a bold pinned thread with the current NVC policy prominently featured and then lock the pinned thread.

Then don't.

Our journey together on this earth has come to an end.

I vote the K-3 process and procedures forum be put in 'read only mode' and the 'status reports section' be left as is..

It is viable so I am not as sure what to do. An easy fix to start is that I moved the IR-1 / CR-1 forum above the K-3 forum. Can we somehow combine and sub-categorize things?

I disagree, vehemently. The K-3 is not a viable visa type to pursue, since 1 FEB 2010. Can the 'Guide Editor' pulease remove all mention of the K-3 in the I-130'd CR-1/IR-1 guide? Yes? Soonish? TIA !

Maybe it is just me, but as long as the USCIS is still processing applications and the embassies are still updating the information regarding K-3 interviewees, this might be a bit premature.

Many of us view it as non-viable.

Those of us who 'see' that non-viability have posted MUCH in the K-3 forum about it.

IF you have not reviewed those posts about non-viability, I suggest you do so, soonish, and start to draw your own conclusions about the viability of the K-3 visa.

The one sticking point - an unapproved I-130 in play at USCIS, doesn't happen anymore, as USCIS approves the I-130 AND the I-129F on the same day.

NVC sees this when the casefiles come in - and will administratively CLOSE the I-129F, as the basis for the I-129F, an un-approved I-130, doesn't exist by the time NVC opens the casefiles.

The K-3 is certainly a real visa, however OBE at this moment. I would be happy to pin a large FYI topic int he K-3 forum explaining this (if someone makes one I will pin that one).

I would also be happy to change the forum description to highlight the current trends. So changing this:

This forum discusses the K3 Spouse Visa procedure for a non US Citizen (living overseas) married to a US Citizen. K4 Visas for children of the foreign spouse (if applicable) are also discussed. Note: K-3 Filers have (automatically) filed for a IR1/CR1 Visa (I-130) and may obtain either.
