My husband was ban for 2 years for admitting he smoked weed over a year before medical. His ban is up July 2011. Do you know if the embassy will contact him or should contact them when it's time? Do I need to file another I130. Have anyone already went thru this and what was the outcome. I'm so nervous. for his second medical do you recommend he go back to the same doctor

i think the I130 is "good" forever. But the drug bans are tricky. Go to i2us.net and read up on them, they have a large number of people dealing with drug bans and more information.

Welcome to VJ and no need to be nervous.. He can go to the same doctor if it's convenient but they have no say really the information is gathered there and forwarded to the consulate where the decision is made. Lets hope he learnt his lesson and we can all move on.

From if he was denied for using drugs then he would be required to start the process over again. did u receive any thing from the embassy/uscis?

Yes, others have gone through it - although both were a K1 who then married and filed a CR1 - one of them is already here in the US - I'll get her to come halep you - my advise, file NOW so that by the time his ban is up he will be near to interview.

yep listen to Sus....def file NOW! and i am one of the vjers she mentioned.....but i am still awaiting a NOA2 on our CR-1.....our ban was up last october on the K-1.....as for going back to same doctor well i say no but my husband insists on going back to same one.....fingers crossed it works out that way

~ 11/06/08 K-1 visa was denied and a 2 year ban placed on our file

~ 02/09/10 married my best friend

I haven't receive anything. Only have the paper they gave him that said he couldnt come til after July 2011. Periodically I email the embassy and let them know I'm still interested in filing for my husband.

The Embassy will not contact him. HOWEVER, you can go ahead and file your new I-130 petition now. My husband and I went through this a couple of years back. Long story short his ban was up in Oct 1, 2009. I filed the I-130 in November of '08, and his interview came up Oct 7, 2009, 6 days after he was eligible and his visa was GRANTED with no problems or questions about the reasons for his past denial! He will have to do another medical. Because I didn't like the way the ish went down with the way the 1st doc did, I had my husband go to a different doc b/c I just didn't trust them. yep listen to Sus....def file NOW! and i am one of the vjers she mentioned.....but i am still awaiting a NOA2 on our CR-1.....our ban was up last october on the K-1.....as for going back to same doctor well i say no but my husband insists on going back to same one.....fingers crossed it works out that way

No need to run from doctor to doctor... They have no power... All they do is report what they see ....and so any "good" doctor will be looking out for the same things hence same conclusion.

I don't necessarily agree with this. The first doc that he went to back in 2006 told him several deliberate lies to get him to admit to his last smoking weed almost 3 years PRIOR to his medical. His actual medical/drug test, per the interviewing officer's report & doctors report came back CLEAN. Yet the DOC was the one who made the decision (I saw the paperwork) that stated that he considered my husband a substance abuser and recommended denial of his visa. The things that he told my husband were absurd. And after doing more research, this doctor had done this to some other people as well. So, yes--the doc DOES have considerable influence.

Why would you "refile" the I130 when you already have an approved I130?

The Embassy will not contact him. HOWEVER, you can go ahead and file your new I-130 petition now. My husband and I went through this a couple of years back. Why would you "refile" the I130 when you already have an approved I130?

Why the "refiling" of the I130 ? Once approved its good, why would you "re-establish" the relationship that has already been established and proved?

Everyone is going based on past member experience, which is slightly different - they filed K1, were denied based on the ban, and subsequently married and filed the I130 - thankfully it seems to be different in the case.

He has to provide new DS230 part 1 & 2, new police record, new medical and from me employment letter, affidavit of support, my tax returns snd W2's and also pay new application fee of $404.00 . Well this doesn't sound so bad, given what you've already been through. What is the application fee for? Am I understanding that you can go ahead and submit the materials, and just ask for the interview in July?
