Hello VJ Friends,

Here are the ff. documents I have sent for my AOS application and I hope it may help you.

*After I got my certified copy of marriage certificate, we start gathering important documents that I needed for my AOS.

1. Get State I.D., The MVD or DMV is issuing State ID which I think it will help me in many ways also it will be my first I.D. under my married name..hehehe & hopefully I can apply for driver's license if I know how to drive already :). I fill-up the forms and presented my certified copy of marriage certificate & passport.

Note: Better to do it once your married so all your documents will be under your married name so no need to re-apply to change it.

2. Applied for my SSN (Also same thing, I suggest to do it if your married already and bring your marriage certificate so,the SS Card will be under your married name)

3. We went to the bank to update my husband's bank account to joint account & include me as secondary owner.Again, it's under my married name (The copy of this docs will include in my AOS as evidence of our relationship)

5. Find USCIS accredited doctor near in our area and scheduled for my medical appointment.

This is actually what I am looking for. Very precise. Thanks! :)

Will I pay for the same amount of $1070.00 for the K2 holder? Do we need to file for AOS RIGHT AWAY soon after we get married? I heard it should be done before 90 days after we get married. Am i right? So does that mean I will also get my GC (if im approved) before or exactly 90 days?

Can I message you for more questions if you dont mind?

How old is the K2? If under 14, and if the K2's AOS is filed with the K1's AOS then the fee is $635. If the K2 is under 14, but the K2's AOS is not filed with the K1's then the fee is $985 - same as the K1 but without the biometrics fee. For K2's 14 and older the fee is $1070.

File as soon as you are able after the marriage. It's preferable if you can file within 90 days of entering the US because you won't have any accumulated unlawful presence. It has nothing to do with when you get married. It has to do with the date stamped on your I-94.

The processing time is going to be more or less the same, regardless when you file. They don't process it faster based on when you file, though filing sooner means you'll get the green card sooner.

How is it that you are adjusting status on the basis of an F2A petition? Are you in the US now? Is your non-immigrant status current (not in overstay)? Is your priority date current?

What do you mean by "they are requesting it"? Did you get an RFE for a copy of his green card? What are the "certain reasons" that he cannot provide a copy of it? If you want honest answers then you must provide details.

My son is 7 years old. So does that mean we only have to pay $635 if we (me the K1 and my son the K2) filed together for our AOS? Does my son needs to see a civil surgeon also? If we file for AOS after we get married, does me and my husband to be need to show up for an interview? Thank you so much for the information you have provided. It is much appreciated. :)

Hi JimVaPhuong. I do have a follow up question if you don't mind. Are their such cases wherein they filed for AOS but got their green card after 90 days? What if we file early for AOS after we get married, will I receive the green card before my K1 visa expires?

Hello...Yes, there were some cases who had received their GC within 90 days or even longer..it depends on your case..we filed last December 2010(before my I-94 expired) and I had my interview last March 17,2011 and got approved(so it's somehow within 3-4 months for our AOS)..with regards to filing your AOS after you get married, then it's good..you can file like a week after your wedding, just make sure you have all the required documents to be submitted for your AOS..somehow I couldn't think you can file the "day after your wedding" coz you still need to have the certified copy of your marriage certificate and you will also need to have your Vaccination Records transcribed by a civil surgeon...I agree with JimVaPhuong, it's really a good idea(a lil safer too...lol) to file your AOS before your I-94 expires..and if you can file K2 together, it would be good as well..God bless!!..

What happens if we file for AOS shortly after we get married but then we get the GC after my I-94 expired? Am I still considered being in the US legally while waiting for my GC?
