I was approved a couple of month ago...

3 of my 4 kids were accepted too to travel later.. but the oldest one (11 years) not.. because of a negative DNA test results ...

I did not know about this untill this moment... so you may know how dificult to a person is to know after 11 years..

Even though that child it's not my biological kid is mine... and I want her with me

I'm about to bring the others 3 and I want to know if there a posibility that I can bring her too..

she's been living with me since was less than 2 years... couse her mother thought that I was her father..

any advice is welcome

That is a tough one i would say you would have to legally adopt her either before or after you come here.

Even legal adoption won't work. Unless the child is an orphan then you cannot adopt for US immigration purposes

Now you also face the problem that the biological father has rights. The father can refuse to allow you to take the child out of the county. You'll need permission to do so I imagine

There is no easy path for you to bring a non immediate family member. You will need to find someone there to take over care for the child or change your plans about moving to the US if you want to keep the children together. Even in cases where the mother is dead and the father is unknown you can be charged with misrepresentation in the case of the child ( it happened to a man in Nigeria with children he had raised as a widower ) You have some hard decisions ahead.

This will not be over quickly. You will not enjoy this.

Is it the mother that is petitioning for you and the others if so then, have your name remove from her BC and then put the mom biological name on there then they cannot deny her being with her mom. But if its not and her mom is not in her life and you are the only parent they will allow you to adopt her if her parents does not want her. I must say :thumbs:to you because a lot of people would look out for themselves but you are what I call a TRUE FATHER hope all gos well for all of you :innocent:

If you are the beneficiary, adoption will work because you are marrying the child's biological mother. Generally, adoption will not work for immigration purposes when adopting a relative. However, this is a case of a man adopting his wife's child. It's not treated the same if the man was to adopt his niece when her parents are alive. Which one looks more normal to you? It's not unusual for a person to adopt a spouse's child. It is unusual for a person to adopt a relative when the relative's parents are still alive.

Consult with an immigration attorney.

Hi, just curious why they requested DNA when you are not the petitioner?what is your visa category?i guess F1 or F2B? Well anyway you can petition her later as your stepdaughter if you will marry/or are married with her biological mother.No need to adopt her.

It has become the norm over the past few years by immigration if the children are following to join with their biologiacl, if the father is the benificeary or if the father is petitioning for them to prove relationship between the children and the father. A mother cannot get a child that is not theirs only in baby theft, but fathers often father children that are not theirs because the mother was with two partner at once and the child was given to the wrong father. It they allow this to happen many people could take a child here and say its his and its not. This is the reason they are now doing it.
