Dear All,

My mother is naturalized US citizen, person of Indian origin. She has got a 10 years tourist visa for India and has been in India since nov of last year. The 6 months period will be shortly up for her. What are the implications of her staying there more than 6 months? Is she risking her US citizenship or future travles to India? She wants to stay there longer, what are the things we have to do to extend her stay there? I have heard about PIO card, can she apply for this in India, where, and how long will it take because her 6 months stay will be up soon, are there other steps she can take to make her stay extended while PIO card is under process? I really need this information and will really appreciate any help you guys can offer in this regard.

If she is a US citizen she can come and go to the US as she pleases, (although she should continue to file taxes, etc.). There is no restriction there. I don't know about the India side of things.

Can you apply for OCI card for her, while she is in India?

You can apply for OCI card via foreigner regional registration offices.

Its a life long visa-free travel to India.

The OCI (Overseas Citizen of India) card doesn't require any specific length / duration for which any non-resident Indian stays in India.

She does not risk losing her US citizenship, it might have some implication when she tries to leave India, they can see she has overstayed her visa.

Lately they have been very strict about it after the past terrorist case came to light where ppl had used to tourist visa.

As per my knowledge, she cannot apply for OCI or PIO card in India, she has to do it while she is here in US and when she enters India she would have to present that + her US passport to immigration officer in India and same when she leaves the country.
