Hi, this is my first time posting but my fiance comes here all the time and said this is a great place to find out information.

We currently have an interview date of April 19, 2011. My father is going to cosponsor my fiancée, as I am currently out of a job and have been for some time now (although I'm actively interviewing and hope to be employed soon). He exceeds the minimum sponsorship requirements so he should be a good cosponsor. According to this document http://www.uscis.gov/files/form/i-134instr.pdf provided by the USCIS that explains the supporting evidence required, it states that he would need to provide:

A. Statement from an officer of the bank or other financial institutions with deposits, identifying the following details regarding the account:

1. Date Account Opened;

2. Total Amount Deposited for the past year; and

3. Present Balance

B. Statement(s) of your employer on business stationery showing:

1. Date and nature of employment;

2. Salary Paid; and

3. Whether the position is temporary or permanent.

C. If self-employed:

1. Copy of last income tax return filed; or

2. Report of commercial rating concern.

He is not self employed so C should not apply as far as this document says. Although my fiancée tells me that according to this website it seems that everyone must give their tax return information. My father is very hesitant to share his tax returns with strangers and would very much like to not have to do that. The rest of the information should be alright.

So does he still need to provide tax return information?

As I have been out of a job, and have very little money do I need to provide for A, B, AND C?

Is there a name for the specific statement from the bank he needs to have signed by the bank officer?

Has anyone gone through the Brazilian consulate and used a cosponsor and knows what to expect from them?

I'm grateful for anyone that can help clarify this for me.

This is a common misconception. Basically, you can ignore the instructions for the I-134. The form and instructions were written by USCIS, but USCIS rarely uses this form anymore. The consulate will have their own requirements for the evidence that needs to be provided, and they will usually specify those requirements with the packet 4 instructions.

Most consulates will want a complete copy of a tax return or IRS tax transcript for the most recent tax year for ANY sponsor. If the consulate requires his tax return or transcript then he must provide it or they won't accept his affidavit of support. The packet 4 instructions for Brazil are here:

You may present your own means of support or the petitioner may fill out an Affidavit of Support, form I-134. The sponsor must attach proof of his/her income such as: copy of last U.S. Federal Income Tax (form 1040), proof of current employment, job offer, pay-slip, etc.

You can check the regional forum for Latin America to see if anyone else has had an affidavit of support accepted as sufficient without a tax return at the consulate in Brazil.

I will make sure to read this over and contact the consulate. I appreciate the quick reply. My fiancée and I are now reviewing the packet 4 instructions as you suggested.

I know that my father is now doing his taxes for the last two years, would a tax return from 2008 be sufficient?

My husband and I were in a similar situation to yours. I (the US Citizen) was unemployed at the time and we used my mother as a cosponsor. I filled out the I-134 and included a letter explaining why I had no tax returns to submit with it. Then I had my mother fill out an I-134 and I submitted her birth certificate, a printed sheet from her company website showing when she was hired, her title, her pay, and that she was employed full-time. I also included the most recent pay stubs (3 most recent) and also submitted her last three years worth of tax returns. It might have been more than necessary to submit, but we wanted to make sure that we didn't leave anything to chance. We did not include anything for a bank since her income from employment was enough.

When you arrive at the consulate you hand them your papers and they will look them over elsewhere before the interview (while you are waiting). My husband had no questions asked about what we submitted.

Thank you so much for your response! I have been on webcam all day trying to figure this out with my fiancée and this was the most helpful so far. That makes me feel really good. I have also gone ahead and emailed the consulate to ask them specifically what they require in comparison to the USCIS requirement document.
