Hello...like a quite few people, my husband and I are finding ourselves in a tight position. I am a US citizen and my husband is British. We have DCF via London where our petition was 'filed' with the NOA1 dated January 19th. We have not heard anything since and are getting nervous we will not be able to complete this process and get his IR-1 visa by July 1. Before we go too far off the edge, thought it might be a good idea to get started on the subsequent paperwork - assuming the I-130 will be approved. I understand the following documents will need to be completed, post I-130 approval and submitted with loads of supporting documentation which we can gather:

DS-230 part i & ii

Police certificate

I-864

Are you aware of any limits that we cannot print and start completing the DS-230, I-864 and submit a request for the police certificate now? Is there anything else we could get in order/completed in advance?

The July 1 date is very important.

I hope I have stated everything correctly and it makes sense. If not, send me your questions.

There's definitely nothing stopping you both getting the rest of the paperwork ready to be posted, just leave the dates blank & have a quick double-check before you have to send them off to make sure no info has changed since you filled them out! I filed in Feb and already have my police certificate in my hands as I applied for it the same day I sent off my first lot of forms to the Embassy, it's valid for 12 months AFAIK. My husband has filled out his portion of the I-184 forms and we're just waiting for his Dad in the US to get his section completed too. I, like you, want everything organised and ready to rock 'n roll for when I get the green signal for the next part of this process.

I wouldn't pin your hopes on getting the visa in hand by July 1st. The London office is super-busy and looks to be pretty backlogged right now. You guys probably wont get your NOA2 for another few months yet.. And then you've still got to go through the medical/interview.

IR-1 Timeline (DCF London)

15th Feb 2011 - Filed I-130 in London.

6th Apr 2011 - Sent letter requesting expedition of visa.

11th Apr 2011 - Received email approving request.

12th May 2011 - I-130 approved.

2nd June 2011 - Received case number via email. Booked medical.

3rd June 2011 - Sent forms DS-230, DS-2001 & cover letter today.

8th June 2011 - Medical Exam (£273.00 for medical & MMR/Tetanus injection)

11th July 2011 - Visa interview at 8am.

14th July 2011 - Visa in hand.

23rd July 2011 - Uniting my family today in San Antonio <3

11th Aug 2011 - Received 10yr Green Card in the mail

22nd Aug 2011 - Received SSN

Your NOA1 date is a couple days before mine so we should be approved around the same time.

Being conservative, I don't think we'll be approved until the end of May. It seems to be taking a little over four months to approve the I-130 currently but that could all change. A few weeks back they were working quite swiftly but now it's slowed down again. And we should bare in the mind the abundance of bank holidays in April.

Having everything ready to send is vital in moving things along swiftly but expect it to take about two months from sending everything back to get your interview. Is it important that you leave by July 1st or your husband? Because there isn't anything stopping you from leaving in advance and having your husband follow after.

Another thing to do is have a look at the medical check list, you can fill this out in advance and make sure you get your vaccination records. And do you have all your tax transcripts/ join sponsor/ intent to domicle evidence?

Don't expect to hear anything until your approval. Unless you get a request for further evidence, usually you don't hear anything.

Check his vaccines. They are nearly free under NHS. If he needs any, you can get them taken care of before his medical. Then get his medical records. Get 5 50mm X 50mm passport photos. Get two copies of the police report, only 5 pounds more. One is needed by medical. (It took longer than posted-- almost 3 weeks.)
