Hey all,

So I submitted an I-130 DCF in Dublin a few weeks ago. Today, an Irish lady (not American) called me from the embassy saying they are returning my paperwork because:

- we didn't submit proof of my wife's American citizenship. This is annoying, because although we don't have her passport at the moment, we did submit her US birth certificate, which is specifically listed by the website as being acceptable.

- we haven't shown that we have been 'permanently resident' in this consular district for 6 months. Now this I don't understand. First, we showed her Irish passport. Second, I didn't know that 'permanent' residence was a requirement ... just 'continuous' residence?

What sort of evidence could we show for this?

March 20: told not enough evidence that we are actually resident in Ireland, i-130 returned

April 1: submitted again with lots of evidence.

May 9: Receive packet 3, return DS-230 part 1 and notice of readiness.

May 16: Receive notice of June 2 interview.

That's very weird, they should've accepted her US birth certificate. I'm guessing your American wife is a dual citizen? So her sending the Irish passport is definitely proof of residency.. Did you tell them that you followed the checklist and are very confused as to why those items are being accepted? I'm baffled too!

IR-1 Timeline (DCF London)

15th Feb 2011 - Filed I-130 in London.

6th Apr 2011 - Sent letter requesting expedition of visa.

11th Apr 2011 - Received email approving request.

12th May 2011 - I-130 approved.

2nd June 2011 - Received case number via email. Booked medical.

3rd June 2011 - Sent forms DS-230, DS-2001 & cover letter today.

8th June 2011 - Medical Exam (£273.00 for medical & MMR/Tetanus injection)

11th July 2011 - Visa interview at 8am.

14th July 2011 - Visa in hand.

23rd July 2011 - Uniting my family today in San Antonio <3

11th Aug 2011 - Received 10yr Green Card in the mail

22nd Aug 2011 - Received SSN

How annoying! Dublin do tend to be friendly but picky with paperwork.

We also submitted the USCs birth cert and that was accepted, so maybe you got a CO at a bad day or maybe the policy changed.

For the residence, they want you to prove she actually lives in Ireland, and doesn't just have an Irish passport. So, bills in her/ both your names, Irish bank account, that sort of thing.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hey all,

Thanks for the replies! Was a bit worried at first, but we're now steeling ourselves and just trying to get as much info as we can together.

For evidence of us being resident in Ireland, we don't have leases or job letters, but we do have records of doctor's visits, a letter from the people we're subletting from, and things like PPS (social security) number letters, and a joint bank statement. It's not conclusive proof, but I hope it's enough.

One thing -- we're really hoping to be in the USA by early June (I've been offered a job that starts on June 16), but time is now getting a bit short. Do you think if we asked them nicely to process our i-130 second attempt quickly, they might do it? As far as I can tell, actually processing it only takes the officer an hour or two, but it takes 3 weeks or so for them to get to it. If we plead, I wonder if they'll do ours quickly, since we've already sent it once?

They wont process the visa quicker no matter how much you beg and plead. However the Dublin embassy is pretty fast so you might be lucky. Don't get your hopes up though!
