N-400 Marriage Licenses

Hi everyone,

My wife and I are finally getting around to filing for her citizenship. We became eligible at the end of January but with both of us super busy at work, we just haven't had the time to put together our application. I apologize if this is covered somewhere else. I've done my best to scan the first few pages of topics and in doing so, did not find the answer to my question.

When submitting the N-400 for 3 year marriage to a USC, is a certified copy of the marriage license required? Or will just a standard copy do?

A standard copy will do. As there will definitely be an interview, your wife can bring the original or certified copy with her to the interview in case they wish to see it. I just submitted a photo copy of our marriage certificate and it wasn't a problem. Good luck!

Good point. Yes, she needs to bring it even though they won't necessarily look at it. They have the right to ask for it at the interview . All of the extra documentation I brought along with all of my originals never left their file folder during my interview .

Can you not just use the same copy you used for AOS? (And I forget if ROC needed it too)?

If you bring tax transcripts, which is what you want to bring, you don't need bank account statements.

This is true of all the evidence you submit with your application, just send photocopies. But bring the originals of all that evidence with you, and likewise you take all of those original documents home with you.

We didn't dare send in a photocopy of our marriage certificate in Wisconsin, says right on it, up to a $10,000 fine for making photocopies, so just got copies from our register of deeds, 8 bucks for the first one, five bucks each for each additional ones.

This is what we sent in for our ROC:

1. Jointly completed I-751 Form

2. Copies of I-797C "Welcoming" and permanent resident cards for Gloria and Jessica.

3. Copy of Nicholas, Gloria, and Jessica's current WI drivers licenses.

4. Four letters written by U.S. citizen friends and relatives, attesting to our relationship and marriage.

5. Joint ownership of our home deed and two of our five vehicles

6. Copies of our mutual health and automotive insurance policies.

7. Copies of our federal and state income taxes with the letter from the IRS showing that Gloria and I have filed a joint return for 2005 and 2006. We were married October 12, 2004.

8. Copies of our banks showing joint checking, savings, and CD accounts.

Scratch off number 4 and add yet another marriage certificate, more copies of our divorce papers, brought along a joint utility bill, two more years of joint tax returns so what our evidence boiled down to was a combination of the AOS and ROC evidence. No wonder why my wife commented that her file was 3 1/2" thick, a lot of redundancy.

Come to think of it, would have been nice if they returned my original of that I-864 I was forced to sign. Well really wasn't, just couldn't bring my wife here if I didn't. But it expired once my wife received her US citizenship. But neither of us went on welfare, yet.
