Hi guys, I found this forum while searching for information on fiancée visas. First, let me explain my situation, which is admittedly very complicated:

1) I am a US national (guy) and met a Romanian girl during the Summer of 2009. She was in the US on a work visa (J-1 visa). We became an item then. She left the country in compliance with her visa in September 2009, and is continuing her college studies in Romania.

2) She got a tourist visa (B-2) for Winter 2009 to visit me for the holidays. It's valid until 2019. She returned to Romania in January 2010 to continue her studies.

3) I left with the Peace Corps for Ecuador in February 2010 (this was already planned before I met her, to be fair!). I currently reside in Ecuador as a PC volunteer.

4) She came to live with me in Ecuador during summer (July - September) 2010 on the normal 90-day tourist visa that Ecuador extends to nearly all visitors, then returned to Romania to continue her studies.

5) I visited her in Romania during the 2011 holidays and returned to Ecuador in January 2011.

6) She will come live with me permanently (in Ecuador, until I finish in March 2012) when she finishes college, around July 2011.

7) We intend to live in the US after I finish my PC service in March 2012.

Like I said, it's very complicated. My question is: What is the best way to go about getting married?

- DCF seems like the best option (I don't foresee any problems showing that I've been a resident of Ecuador for around a year, PC could provide documentation). My worry is that the consulate in Ecuador is going to tell me that I need to talk directly to the Romanian consulate in Romania.

- Since she has the J-1 visa we could get married in the US but I've read that it would be a very bad idea to do so since it would break the terms of her visa

- One idea: She could come with me to the US on the J-1, we submit the application for the K-1, and she flies back to Romania when it's time for the interview, then comes back on the K-1.

Does anyone have any advice for me? I'm pretty lost and long distance is hard enough that I would really love to have some peace of mind in knowing what the best approach would be. Obviously I don't have a lot of money (being a PC volunteer will do that) and I would really like to avoid having to be separated again, after all we've been through.

2-7-11 - Day 0 -sent AOS package (concurrent filling)

2-11-11-Day 4 - received text message from USCIS with the receipt number

2-18-2011 - Day 11[/font]- received NOA 1 in mail for I-130, I-485, I-765, I-131

2-22-2011 -Day 15- received biometrics letter -appt March 14

3-10-2011- still cannot see case online although I called USCIS two days ago

3-14-2011- Day 35- Biometrics done on the appointment day

3-24-2011-Day 45-case showing up online!!!! USCIS mailed on 3-23 my interview appt letter- April 26 is the day!

3-26-2011-Day 48-Received interview appt letter

4-1-2011-Day 59- USCIS mailed I-131 approval and ordered production of my new card (I assume the combined EAD/AP)

4-11-2012-Day 69- received EAd&AP combo in mail! Bad picture!

4-26-2011-Day 84-APPROVED!!! Card production ordered!

4-30-2011-Day 88-Welcome to America letter received

5-4-2011-Day 92 - received green card in mail (8 days after the interview) - it is kinda green!!!!

It seems DCF would be the best option for you (cheap, fast, she has a greencard upon entry to the USA), assuming she can get a visa to live with you in Ecador for the time b eing.

I don't see the Romanian consulate having anything to do with it at all?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yeah, her visa in Ecuador should be no problem. I think I phrased the consulate question poorly; I thought that maybe I would have to talk to the US consulate in Romania to set this up. But it sounds like I can just talk to the US consulate in Ecuador, which would be great!

I'll try to follow up on this whenever it is resolved, thanks.

She will need to qualify as a legal resident in Ecuador when you submit the petition. Check with the embassy/consulate to learn what they require to prove legal residency.
