hello all...!

Here is my story... My fiancee in USA filed the k1 petition in July 2010.. when we wasnt engaged..! After filing petition she came in India in November 2010 and we got engaged, with a big function. Then she went back and we got NOA2 in December 2010. After receiving packet 3 and packet 4 and submitting all the required documents at VFS new delhi, I had my interview on 9th of march. Everything went goood, but in last the consulate handed me ove my passport and 221 g form. I was ok with that.. then i submitted the documents at VFS on 11th of march (extra stuff as proof of relationship which was required). But the saddest part is that in period of a week.. they sent me back all the documents with my passport with no visa.. saying that your petition has been expired and we are sending this case to USCIS for further review...

I wanna also add that our petition is not expired yet.. it is going to expire on April 13th.. We are confused and dont know what to do and what to expect from this now..! we are totally heartbroken..! Please tell us if somebody has the same case..!

So sorry for you.Can you please list down the questions that were asked by CO,How long was the interview,How was the attitude of CO towards beneficiary,Was the CO American or Indian. Please list down all the details of interview process so that people here can help you.

Meanwhile,Pls contact ur congressman and senator immediately and prevent the petition from going back to US.It will take months for it to reach USCIS and then again months for them to review it.HURRY UP....Dont waste ur time.

I am in same boat. My fiancee had interview on 8th, we just submitted the paperwork on 3/18. From what I have read once they issue a 221(G) it is pretty much end of road for your K1, but you never know. I think best way is to get married and file again, it's a long road but what can u do.

Regarding your case, e-mail the VFS and let them know that your case hasn't expired and request them to review it again. Ask your partner to call local Senator/Congressmen to enquire on your behalf. All these things might help to keep the petition in New Delhi.
