CBP will likely have access to information that will show an immigration benefit has been filed on your behalf.

No they don't.

Call it whatever you like but in Dublin after you speak with an officer when you land in the U.S. you pick up your bag that's it.

Yes, that's a Preclearance Center.

and Dublin isn't in the UK it's in Ireland.

He didn't claim it was.

Moving from the K-3 forum over to General Immigration Discussion. Welcome to VJ. :)

MIne was denied at the border, but had been previously denied a student visa. That opened him up to secondary questioning and search. He's a big strong rugby player. I guess they thought he was too much of a risk to steal an illegal cash construction job until his K1 came in. (At least that's what we have decided, as his record is completely clean.) Now, I go East!

Hi!

I live in America and my fiance is British. We are waiting for our K1 and should be receiving the ok in few weeks (we filed in November of 2010). My fiance came over Christmas to visit and had no problems, at all in Detroit-his flight was Heathrow to Detroit to Indianapolis. the only thing I would recommend is to bring ploenty of proof that you will be returning to U.K. (evidence would be proof of car or home ownership, bank statements or pay stubs-proof of employment in U.K.). My lawyer suggested these things before my fiance left U.K. Hope this helps! Good luck to you both!

Thanks for all the advice.

I've thought of a new issue - my Visa Waiver/ESTA expires in October 2011. So it'd be valid for a visit to USA planned for July 2011, but happens when it expires. By then I'll be halfway through the Visa process, so I fear I'd not get my Visa Waiver renewed. Does anyone know what the situation is with that?

ESTA?

I have never heard of anyone having a problem, if it worrys you, renew it now, it is good for 2 years.

You can actually reapply for the ESTA anytime and it would renew the date it expires.

  • 4 months later...

Hi everyone. Great site! I've read lots of useful guides and topics.

My question at the moment is about me travelling from UK to USA for a short visit while our application is pending. Basic details:

Me - In UK

Wife - in USA

Met 2 years ago and had several trips to each others home country since.

Married a few weeks ago in UK 19 Feb 2011.

Priority is to be in the US together as soon as possible so our plan is to get a K3 visa (but also peition for IR1) then AOS when I'm in the US.

I-130 being sent now.

I have read anything from horror stories about people getting rejected by customs to those who travel frequently into the US with no problem. So... should I be concerned about travelling for one or two short breaks with my wife in the US while the visa application is in process? (I'd prepare as per common advice having documentation, etc with me when travelling - I have evidence of ties to home/work, plus any other stuff proving our relationship).

Just thought I'd complete this thread- I started it to ask if I was likely to have a problem as detailed above.

I renewed my ESTA and travelled to the US for a vacation in July 2011. They asked me the usual question "what is the purpose of your visit". I told them I'm here for a short vacation with my wife. "Is she at college here or something" they asked. "No, she's American and lives here. I intend to move here at the end of the year, we have a visa application in process at the moment".

*they stamp my passport* and simply say "welcome back".

Easy :)
