Hi All,

Hope for some guidance here.. Currently going through IR1 process (NOA1 dated Mid Jan 11). (Wife US, Me AUS).

I have a B1 business visa which I obtained after NOA1 for business travel to the US (Company headquarters) which I travel regularly for genuine business (and of course spend time with family on the weekends).

Possibility of company transfer to the US prior to my I130 being approved (NOA2) and subsequent processes.

What is best course of action here ? Company is aware of i130 and B1visa.

What visa would they sponsor for you? Are you sure you'd get whatever visa it is before your IR-1 would be approved? If so, I woiuld go ahead and apply, but make sure it is a dual intent visa (such as the H1B), so you can do AOS and stay with your family.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
