lol DQ always throw cold water into the bonfire, but he speaks the truth. vn women are pretty vicious and cutthroat in these matters.

my dad is a counselor for the vn community here in socal so all the domestic abuse cases goes through him and i hear alot of these and similar stories. half of the time it's the vn girls setting up the drunk husband then calling the police.

So how s about the criminal about " Sell drug" and 4 yrs in jail...?...that wat my husband had to pay for the fault that he didnt do...just because going out with bad friends who "sell drug"...im so worry..COuld this have any trouble ?....thanks all

If your husband is the petitioner then it won't make any difference. It's irrelevant for an IR1 or CR1 visa petition.

If your husband is the petitioner then it won't make any difference. It's irrelevant for an IR1 or CR1 visa petition.

yes, my husband is the petitioner...but what do you mean about "it's irrelevant"??..does it mean impossible for I-130? :((

No, "irrelevant" means it won't make any difference, it's not applicable, they won't take it into consideration, they don't care.

There are a few sections of the immigration law where the criminal history of the petitioner is relevant; meaning that it might affect the approval of the petition. For a US citizen filing a spousal visa petition, the main things they would need to worry about are violations of immigration law (visa fraud, human trafficking, etc.) and crimes covered by the Adam Walsh Act (sexual crimes against a minor). The overwhelming majority of other crimes have no bearing on a US citizen's eligibility to file a spousal visa petition.

Is he a USC yet? if yes, did he become one before 1996?

If you're NOT a USC and have a past criminal history, even when the charge was very small and insignificant, you should be very careful each time entering back into the US. The USCIS can decide to deport a criminal permanent resident anytime it chooses to, for whatever crime conviction, no matter how small.

4 years in jail for drug related charge is NOT a small crime!

I mention this because you said he sponsored you as I130. Only USC can petition I129F.

Meaning her hubby can be or not a USC. Only a USC can file I129F.

I just point out, not just her hubby particularly but in general, if anyone has a past criminal record, think twice (after carefully consulting an experienced immigration lawyer) before exiting the US and reentering at a later time.

The USCIS might not care enough to go after you in the States (for small crimes). But you're risking it at any US custom at the airports. But to most in here, they already like to gamble anyway!

One of my little brother was setup from his ex-wife. Eventhough, he not even DRUNK or touch her. He was in jail, and got the retained order, and she only holding 2 yrs of GC not 10.

03-04-2009 : NVC has received the Choice of Agent DS-3032 (Online)

03-04-2009 : IV Application Processing Fees $400 (Online)

03-05-2009 : Payment Received from my bank (IV APS)

03-07-2009 : DS-230, and I-864 Sent (by USPS)

03-12-2009 : USPS confirm arrived at NVC for DS-230, & I-864

Only a US citizen can petition for an IR1/CR1. An LPR petitioning for his wife would petition for an FB2A.
