I am on the process of my I-751, now want to petition my husband for AOS

Hi anyone here have the same situation as mine? I am a permanent resident where my I-751 still on process to lift my conditions, i got remarried and i am now applying for my husband ajustment of status from his H1b working visa to permanent resident through relative petition which i am doing now the I-485 and I-130.

does anyone has the same and granted the spouse a green card? or i shall wait for my 10 yr green card before i petition him? i submitted my I-751 last Nov. so the process is already been 5 months, i have the extension letter for 1 yr and i have done my biometrics too last November.

received receipt & extension 1 yr. 11-20-10

NOA -notice date 12-1-10 received 10-6-10 biometrics 12-17-10 8:00am

Biometrics taken 12-17-10

mailed original divorce copy 12-17-10

Re-married 12-28-10

RFE-finger print cannot read - 3-25-11

Sent police clearance - 3-27-11

Production of card - 4-9-11

I would worry about getting the conditions removed first because you still have to prove that you entered the marriage with the USC in good faith.

Your new husband can't adjust status as you're NOT a US citizen - no immigrant visa number immediately available to relatives of LPRS.

The best you can do is send the I-130 now and wait the 3+ years or whatever the time period it nowadays for FB2A petition to get the immigrant visa number.
