EI while waiting for Green card?

Hello to my fellow canadians,

I applied for a K1 visa in early Feb, so I just started this long process, my question is after looking threw this site am I able to claim EI from Canada after I immigrate to the states and am waiting for my greencard?

According to this link on here it would seem that way.

Does anyone here have any info on actually doing it and what you need to do to qualify for it?

To be able to collect Ei--one has to be legally able to work!! With the K1, ur not legally able to work until u get ur EAD or greencard! There was a time when some k1'ers without the EAD were getting EI, but I believe that was because the CDN officials didnt know the K1 USA immigration rules. I do believe that has changed, and they are back to one requiring the EAD or greencard

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

So basically the only way you I would be able to claim EI from canada is once I get my Greencard and have authorization to work.

Yes. If you were pregnant, then thats a different,lol, one could collect maternity benefits. And no, I didnt see any mention of pregnancy,lol

Wow, Flames, you answered this for me on CanucksAbroad just yesterday! Funny how topics seem to come up. I looked over the links you sent me, and the only way I can see around the wait, is if you are lucky enough to find a POE officer to give you a stamp for your EAD right away... does that ever happen?

Yrs ago SOME POE's gave out the sought after EAD, but that appears no longer the case. And I think even if one did get the EAD at the POE, it would have became null once u got married????? I came on a CR-1, so dont follow the k1 that much.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

EAD stamp is not for K-1s, if one is given it does not authorize the K-1 holder to work. You need to apply for the EAD card if you want to work before the green card.

Are you able to apply for EAD before you get your greencard?

At 1 time he k1'ers could get an EAD stamp at a very few POE's!! 1 of the last ones to give the EAD stamp was JFK. But The process has changed.

You can but if you apply for EAD before you apply for AOS, you will pay an extra fee and your EAD will expire the same time as your I-94. If you apply WITH the AOS then there is no fee for the EAD forms and it lasts longer than the I-94.

However - applied for together, the EAD does tend to come before the GC these days, does it not? So yes...you will be authorized to work before your GC arrives if it works out that way, no guarantees but sometimes the GC is a bit longer being approved.

I was working as a teacher in Canada, before I moved to the US on my K-1. The school year finished at the end of June, but my contract ran until the end of July of that year - 2009. I entered the US at the Pembina, North Dakota land crossing on July 12, 2009.

I asked about the EAD stamp at my PoE. They said they weren't giving them anymore.

I applied for EI within a few days of the formal end of my contract, in early August 2009, from the US. They approved it, but said I couldn't receive any benefits until I could show that I was ready, willing, and able to work - that is, until my EAD came through.

I got married on September 12, and sent in my AOS package, including EAD application, on September 23. My EAD was approved in mid November.

In January, 2010, they finally got a copy of my EAD (there was some miscommunication with them about that) and they sent me back-benefits back to when my EAD had been approved in November, and continued sending them until I got a full time job here in mid-April.

Having been a teacher, I couldn't receive benefits for August anyways, because teachers normally don't work during August. So the window where I didn't receive benefits [and possibly could have, if things had worked differently] was really just September to mid-November - 2.5 months. If i'd gotten married immediately after PoEing, I could have had my EAD 2 months earlier - in mid September, which would have made that gap only a few weeks.

Straight south on Highway 75 for 1 hour, and then you hit that building that looks like a brick wall built across the highway along the border. :)

One thing to add, though you won't be eligable for EI until you have your EAD or greencard (whichever gets to you first) you do need to make sure you apply for it right away so that it doesnt get disqualified. They will just put your claim into a kind of limbo until you can get them a copy of your EAD or greencard and start paying you as of the date the card was issued.
