Hi All! Am doing my AOS interview with my wife next week and I still do not know what to say if IO asks if I worked prior to AOS application. My lawyer adviced me to say that I worked ON and OFF to survive but a friend said that it would be better to tell IO that I did not work at all. HELP!

Your friend is a friend with bad advise. Listen to your lawyer and tell the truth.

I used to do cleaning to pay bills in private homes. That is what I wrote on my forms. The reality is you had to have been working illegally to pay for stuff here in the USA. They know and this is forgiven.

Always tell the truth - it could screw you seriously if they find out you weren't truthful. Working without authorization is forgiven with AOS for immediate relatives, so it won't keep you from being approved. Good luck.

Overstay and working without authorization is not being made an issue of at the AOS interview. Lying is a reason to be deported with a lifetime bar attached. Now all you have to do is decide which one you prefer.

And another one recommending the same - and wanted to add my own experience.

I've been married once prior to my now wife - due to her lack of tax-returns and back taxes making her not wanting to file her petition for me I wasn't able to file for AOS right away. The marriage went downhill and eventually got divorced. During the separation I worked for 2 years (my employer never asked for my legal status and had me on regular payroll) and filed my income tax returns.

I found love and re-married, at a consultation with an immigration attorney prior to filing AOS and he added to the "work and overstay is forgiven" that USCIS would question you more when they see that you have been in the US for years but have no work history - as he said to me "they would wanna know if you maybe been doing some illegal stuff like selling drugs, prostitution or so or how else did you pay for your rent and bills, food".

At the interview this past February I was only asked if I am currently employed - no question about the work I put down in the forms despite not having an EAD.

So again, yes, be honest with everything, its appreciated and so they see your good moral character, part of the interview observations they do.

Hi! I understand you need to tell the TRUTH in everything. But wouldnt it be misrepresentation or something since I didnt write my work in the G-325a? If I do tell the truth about my work, wouldnt the IO ask why I didnt write it down? If so, what should I tell the IO?

You could always go to the interview with an updated G-325a - detailing the work.

Since you filed taxes - that complicates things, because if you don't say you worked, and they check, (seeing that you paid taxes), as JustBob pointed out, you would of made a misrepresentation.

Did you have a valid SSN for those taxes? or filed some other way?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Hi! I applied for TIN and filed taxes using that number. I dont wanna pay for penalty that's why I filed.

So it's ok to bring an updated G-325a? what do I say though? why am I submitting an updated one? I just sent my packet last february 11,2011. they might ask why I did not put my employment history in the first place right?
