Hi Everyone,

It's been a while since I've posted and have read posts....I've been trying to get everything for the I-485, 765, 864 together....waited for what felt like forever for my joint sponsor to get all her stuff done...and I will be mailing everything tomorrow.

I was wondering if it will be a big problem that these papers are a somewhat overdue. We are a K-1 case so my (now husband) entered the US as a K-1 visa. We married within the 90 day period he is given...but we didn't get the Adj. of Status documents in yet. Like I said I will be sending it tomorrow first thing but he entered Sept. 13 making Dec. 13 when his visa expired. Being that it is Feb. 21, will I run into problems???? :unsure:

Any info or advice is GREATLY appreciated.

Oh yeah, I was also wondering....the processing time for the I-485 says June 16 (CSC)...does that mean they are 8 months behind?? How often does this date change? How long am I looking at before my case will be looked at? I remember going thru this with the 129F package...how does the EAD work? Will it only be processed when the 485 is?? Is there anyway to get my husband working soon?? Sorry for all the questions...just trying to prepare myself. Thank you for all your help!

Jan. 14, 2004: WE ARE APPROVED!!!!! (54 days)

Jan. 17, 2005: got email notice of approval (57 days)

Jan. 20, 2005: Received NOA 2 in the mail

Jan. 23, 2005: Received email from NVC...CASE ON ITS WAY TO RIO DE JANEIRO!

May 25, 2005: Interview in Rio; VISA APPROVED! =)

Sept 13, 2005: Arrived at POE in JFK

Oct 14, 2005: Wedding...starting adjustment of status process...paperwork everwhelming....

Feb. 21, 2006: FINALLY got papers sent in...what a relief! Again...the waiting begins!

Feb. 23, 2006: Applications received (EAD/AOS)

Hi, your hubby is technically "out of status" but as long as you get the AOS application in soon it won't be a problem. They don't usually penalize you for taking so long to get the paperwork in.

Don't go by the processing times on the website. They aren't all that accurate. Best thing to do is find other people that are going thru the same office as you. ( Your city) Some might have already gone thru AOS process and you can guage things by their timeline.

Feb 23rd 08 Recieve NOA letter stating they are extending my Greencard for another year.

March 11th 08 biometrics appt.

May 29th 08 recieved email stating Card production ordered

June 7th 2008 10 yr card recieved.

Dear Michelle

Just to let you know my experience, we didn't file for my AOS until 3 months after we were married and my visa had expired and it wasn't a problem. It all worked out fine as I got my green card after only 3 months. I've never seen any posts were anyone actually had any problems after filing a few months after the visa expired.

Good luck and I hope the AOS process goes quickly for you :)

Michelle, things seem to be speeding up considerably in the AOS department so don't fret. He should get his EAD within 90 days of NOA1 (if not you can apply for an interim EAD and get it on the spot after 90 days). Good luck and get those papers sent in!

Don't worry about the processing times. I was incredibly discouraged too. But my husband entered the US 6 months ago and we got his AOS package out about 5 1/2 months ago, and we just recently were approved for a green card last week. So things seem to have sped along, for lots of people recently.

Try not to worry about the processing time... it will happen when it happens. As long as you've got your EAD and Advance Parole it doesn't really MATTER when the actual greencard comes up. I was married in December, applied in April, and was approved in January.

Others have posted sending in the AOS late and not suffering any problems but I would still recommend getting it in as soon as possible. Good luck :D
