Hello everyone,

My name is Andy and my wife's name is Julie.

We have been together for over 2 years now and just got married a month ago! :)

I come from Israel and my wife is a U.S citizen we both live here (Chicago) and got married here.

My question is what is the next step that we take now, after we got married and got our certified marriage certificate?

Hi Andy,

congratulations. I do not know with what visa you entered the US (or whether you had a visa at all), but the next step now is to adjust status to lawful permanent resident (LPR) which is what a Green Card holder formally is.

You guys need to file the following forms with USCIS: I-130 ($420), I-485 ($1,070), and I-765 ($0 if filed concurrently, which is what you want to do. The whole process will take anywhere from 3 to 6 perhaps even 7 months. You'll have to get a medical done, for which you'll have to see an approved civil surgeon, and there will be an interview. Once you've done with all that and have been approved, you'll receive a 2-year (conditional) Green Card, the condition being that you stay married to July.

I'll assume you need to file AOS to obtain a green card and LPR status.

i have enter the U.S with B2 tourist visa.

Where and how do i get the medical done? How does that process works?

Also another question, I noticed in the I-130 form, there is a field I need to fill that asks: "Date authorized stay expired, or will expire as shown on form I-94 or I-95" but looking at my I-94 form, it doesn't say when my authorized stay will expire, so what does it mean? And what should i fill in the field?

Overstay is forgiven for the spouse of a US citizen.

No i didn't intend to stay when i entered, i was coming to visit but then we decided that it would be better and easier for both of us if we just got married now ( we first planned to get married next year).

Since you did not have intent, it is not fraud.

You have a date of entry and a date that you're suppose to leave the US on your visa entry, right?

How much time did they gave you on your B2 visa? It's usually 3 to 6 months. You'll be fine as long as you apply for adjustment BEFORE the "leave" date!

You have a date of entry and a date that you're suppose to leave the US on your visa entry, right?

How much time did they gave you on your B2 visa? It's usually 3 to 6 months. You'll be fine as long as you apply for adjustment BEFORE the "leave" date!

That's the thing, there is no date stating when I'm supposed to leave...

so that is why im confused what to put in that field on the I-130 form.

I came here in September 2010

And i don't have a stamp on my visa/passport with the date! There is a stamp, but only the date i arrived is in it!

Ok dont get confused. It doesnt matter when you arrived. You usually get 6 months on a B1/B2 visa so your time has either run out or is about to run aboutm but it is ok.

You are the immediate relative of an American citizen and you can adjust.

It doesnt matter how you came, as long as you entered with inspection.

It doesnt matter if you have overstayed on your visa.

It doesnt matter if you decided to marry on the spur of the moment.

You can adjust your status.

Read the guides at the top of this page relating to AOS, You will need to file the I-330, I-1485, and the I-765 (If you want to work in the USA while you are waiting for your case to be adjudicated. It will cost you around $1500 to file these forms. You will need a medical completed by a USCIS civil surgeon and this could cost you from $150 upwards depending on where you are.

You can download the forms you need from the USCIS website. Make sure that there are barcodes on your forms.
