Hi all. As the title indicates, I'm new here and am pretty overwhelmed. Hopefully this is the right forum.

To give a brief overview, I'm a US citizen and my husband is a Canadian citizen. I currently live in NY and he lives in TX. He is on a P-1 visa until 10/2011, although his season ends in April sometime (He's a hockey player).

We've been married almost three years (6/2008) and together for seven. To make a long story short, when we met, he was on a P-1, we got married, he moved to europe to play hockey for 3 years, he's been back for 2 years, but plans to retire this year; therefore, we really need to get our butts in gear with his paperwork.

I'm worried that we have done something wrong and it will negatively affect our application. While playing here, he always has a P-1; however, we own a house in NY and in the off-season, he typically returns to Canada for a week or so, then comes back to live at our home. It was our understanding that, as a canadian, he is allowed to stay in the US for a maximum of 6 months at a time before either (1) having his P-1 reissued, or (2) returning to Canada.

As I read through the forums; however, I believe we have overlooked the "intent to immigrate" qualification and now I'm not sure what to do. Have we totally screwed ourselves?

If any of you have suggestions, or can point me in the direction of some reading material, that would be very much appreciated.

I would file a concurrent adjustment of status by following this guide.

You've alleviated my fears that we havent totally screwed up along the way (well, at least to the extent that posters on an anonymous message board can), so thanks.
