Letter of Intent to Marry Within 90 days of Admission

I wish I knew about this website before we filed our I-129F fiance petition. Our reading at the time we both were filing the form is that we would be submitting our letters of intent, i.e., my finacee and I, 90 days prior to her entering the states. Given our interpretation, we did not file it along with our petition papers but rather thought we will send it later when asked. Well knowing this websie and the informative guides, FAQs, etc. on visajourney.com, I realize we should have send it out. :crying: Now my question from my fellow petitioners or those who have gone through the process, should i send out a letter with the letters of intent. or should I wait for a RFE letter in the mail? I already have a NOIA. My Notice of Receipt was dated August 15, 2006.

sory to hear that... this is just my opinion so i might be wrong but i think you should wait for an RFE if they will request for u or not (hopefully). coz if you send it now w/ out them requesting it and knowing the files/cases at the USCIS are tons and tons of piles, it would probably be lost or they wont give any time to find your case and match it w/ letter the of intent... just my 2 cents... but good luck :thumbs:

sory to hear that... this is just my opinion so i might be wrong but i think you should wait for an RFE if they will request for u or not (hopefully). coz if you send it now w/ out them requesting it and knowing the files/cases at the USCIS are tons and tons of piles, it would probably be lost or they wont give any time to find your case and match it w/ letter the of intent... just my 2 cents... but good luck :thumbs:

Wait for the RFE. right now, if you just send your letters of intent, it'll be much more difficult to locate your records on file. When the RFE comes, you'll have an assigned file number when you return your letters. It'll be much easier to correctly match your newly sent letters with the application already on file.

I was one of the lucky ones and found the site while I was working on finishing the package, and saw the letters of intent and quickly did one for my fiance and sent to her, she signed it took a picture and sent me the picture, I then printed the picture and submitited it along with all the other documentation.

I would just wait for a RFE they may or may not send you one. Also know CSC is back-logged so an RFE may not show for another month or two.

You are truly a lucky individual Dan. You sent them a copy of letter of intent, not even an original, and they passed you on. Simply amazing.

There have been people on here who got RFEs because they sent copies of the G-324 forms and not originals but you get away with sending in a copy of the letter of intent. Nice. Some people are just blessed.

Just wait and see. You never know what they will do, since there never seems to be consistancy between the different offices and adjudicators.

The guides also tell you to turn in a letter of intent at the K-1 visa interview. When we tried to give one to the lady accepting the documents, she handed it back. So who knows.

Is there any harm in sending it in? It might save you a bit of time, or it might not get matched to your case and you may still get an RFE. But it's a letter - not an original official document.

As others have stated, it would be best to wait til you get an RFE. The guides also state that an updated letter of intent, dated closer to the actual interview date will most likely be asked for. They usually want the actual signature on the letters so a copy might not do it.

We submitted ours with the original petition, and then when my husband submitted Package 3, we submitted a new letter of intent.

I would be pro-active and not re-acvtive. The "Letter of intent" is a must have to your filing I=129f. You have stated that you have a NOA1 which would also mean that you have a CASE NUMBER!

I would send Original letter of intent letters from you and you significant other with a clearly written and short cover page stating your addition with the CASE NUMBER on this cover page.

Yes!!! It is recommended that you update these letters of intent AFTER your NOA2 approval to bring to the interview.

Why wait???? The instructions state that this is what needs to happen before an NOA2 approval, why wait for someone at CSC to point it out when you can correct the mistake before hand? You found the mistake by being a member of VJ instead of receiving the dreaded RFE!!!! RFE's are BAD!!!! And only delay your approval.

Again, My 2 cents :D

Yes, LuvLife is right. I didn't read OP's post clearly. I didn't think he had the NOA1 already. But indeed the OP has the NOA1 already. That has the WAC number so he's got a file number. You should be able to make a copy of your NOA1 and send in your letters of intent along with the NOA1 and a cover letter. That should do it. I would also suggest you go ahead and be pro-active. There is no harm in doing this.

I question this advice.

I had much to say about the last post but decided to let things lay as "YODRACK" was the post and I didn't want to feel the wrath of being wrong in my opinion???

Yodrak has been here a lot longer than most of us...most of the time those that have been around a while happen to have the best advice. It's worth listening to, whether you like it or not.

It still remains the best advice to wait for the RFE. And if one reads the instructions on the form, as well as the guides on this website, some things are pretty clear.
