I-864 Question

I know this question is probably addressed on here somewhere, but my brain is so overloaded with I-864 info, I am about to explode.

Here is my situation:

We are submitting I-864 and DS-230 at the same time for our CR1 Visa (Spouse)

I am self-employed, and this year, I made 3K over the guidelines, last year I made 2k under. I have bank statements to show current income and some in savings. I feel they might scrutinize my taxes and income because there was a jump in my income. But, being self-employed in this rocky economy, that is normal. The bottom line is my current income meets the requirements.

My daughter, who lives in the household, has income of about 15,000 annually. I don't feel right about asking her to co-sponsor unless I absolutely have to, call it parent pride.

My understanding is that the DS-230 will take a lot longer to approve than the I-864, so if they say I need a co-sponser, I will have plenty of time to add my daughter's income and not delay the case, but>>>

Being self-employed, I always worry about an IRS audit or extra scrutiny, so would it be in my best interest to just include her income at the beginning so they do not think that I bumped my income up just to meet the requirements? Or just submit my own info for now?

Hello, if your income is your real income, there is nothing you should worry about and since you are above poverty guidelines you don't need a co-sponsor :thumbs:

Find a job you love to do, and you will never work another day in your life.

Hi Queenie! Good luck to you! If it were me, I would go ahead and get a co-sponsor just in case. I know they will usually look at your last 2-3 years of tax returns. You don't really wanna give them anything extra to scrutinize, so to make it easy for them, just get the co-sponsor. Besides, there have been recent cases where they were told AT THE INTERVIEW that they needed a co-sponsor and the spouse who travelled down to JA had to come back and go through all that rigamaroll. Hope this helps!

By the way, your daughter can not be a co-sponsor cause she is below poverty guidelines

But she is part of the household since she is my dependent, so it raises the household income. As I understand it, it is different if they live in the household and are counted in the household size.

NVC will probably approved you based on your current income meeting the requirements, but the income issues will raise it's head at the consular level. The Jamaican Embassy may request a co-sponsor because you will only be able show 1 out of the 3 years in meeting the requirements of 125% above poverty level.
