Hi guys! i really need your help.. im a green card holder. im also aware of that i should only be out of the states for only less than a year.. and i went back here in the Philippines last April 9,2009 and that was my first exit from the states.. i've been out from the states for almost 10 months now since my last entry back in the states in Los Angeles was last April 4, 2010 and i went back here May 29, 2010.. and im planning to re-enter the states in Guam which im aware of that it is a US territory and which im also concerned of.. Im here in the Philippines right now, and planning to enter Guam this coming April because of financial reasons and time constraints.. I'm planning to go back to the states for good next year 2012 after i finish my school or being a graduate.. i really need your help and advices on where to re-enter?? do i need to go back to the states/main land or can i re-enter Guam?? i want it to be safe and my Green card wont be captured by those consoles.. THANKS a LOT PEOPLE!

You should try to ensure you re-enter the US prior to going over a year (without a re-entry permit). (details here)

Since you said you were coming back in April - that should put you at 11 months. (close - but still under a year).

However, I would suggest you apply for the re-entry permit for the next trip. (you can get them good for 2 years)

I am not sure if Guam (entry) would count, as everything on the 131 says "United States" - doesn't mention territories. (however - the Google Hive Mind suggests that it will count)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Thanks Bobby! i am really planning to go back to the states (Los Angeles) but i've got some financial issues.. but then its better to make it sure that they wont file an abandonment against me.. when i went back to the states last year April 2010, i tried to apply for a re-entry permit but the console told me that i wont need it coz i'll just be out for less than a year.. bad thing for me i didnt ask if Guam is a safe port of entry which is soo depressing!
