Hey all. I was taking a look at my copy petition... I swear I do not know how I overlooked the signature and date on the biographic data form....I understand they might send the petition back to me for my signature? They're supposed to receive my petition package at the dallas lockbox facility at around 12:00PM tomorrow.... damn am I ever dejected over this... Everything else in the whole petition is signed.... Will they take it further and then eventually send an RFE or will they just send it right back for my signature? Thanks

Sorry to hear that, the same thing happened to me with my biografic form for the I-130. They did send me a RFE and they also requested 2 more photos. I wondered the same thing, how in the world did I overlook that? :blink:

Good luck, things happen for a reason and it will be only a delay of 2 weeks. Get everything ready again, fill out that form and make sure EVERYTHING is filled out and correct, so if you receive a RFE you have it ready to mail the next day.

Don't they usually just return the packet if you submit the wrong fee or forget to sign the check? My thoughts are that you'll get an RFE, as Amber and Ahmed did.

It varies from what I've seen. If your petition was accepted by USCIS and you have a file number (NOA1) it's going to be sitting in a box untouched for the next few months. It seems that most times they won't even look at your petition until they're actually about to adjudicate it.

If you know for a fact you forgot to sign I recommend you try to find a way to send the signed new copy to them & catch it up to your petition...now I am not sure if this can be done, someone on here may say it can't be done. But it sucks to get an RFE after 5 months...that is where we are, after our 5 month mark, now on day 7 after the RFE email notice waiting to even find out what the RFE is for!

Won't tell us on the phone, told us it will come in the mail with in 15 days... :wacko:

So to spare yourself sadness later, maybe try to send it to them somehow...

my two cents, and remember my two cents could be wrong...

Unfortunately you can't send a correction prior to getting an RFE because it will just get lost in the sea of paperwork at the service center. This is because they have no way of matching up your correction with your submitted petition (I don't know how or why, it is just how they roll). You'll just have to wait for that RFE to arrive after five/six months and send the correction from there. Once you get an RFE, and send your correction, it typically takes two to six weeks for you to get the approval if you did everything else right. Sorry to hear about this. It's silly that such a minor mistake can cause such a major setback.

This is not always true. A few people have sent in required information without receiving a formal RFE and actually had it match up to the petition. I don't think that's necessarily the norm, but it can be done. There is generally no harm in trying, either. Make a copy of what you send in, attach a copy of your NOA1 when you receive it, and hope for the best. If it doesn't work, then all you're out is the price of postage.

Ok so if I wait and I receive my NOA1 in the mail... suggestions? Fill out a new form and sign and date it? Then send in that and the NOA1? Attach anything else? Like a letter of explanation? If so... any ideas on how to prepare that, I'd appreciate it if you or somebody who reads this can tell me what the best way to arrange it, would be. And I guess I wouldn't send it to the lockbox facility... but to where it gets forwarded?

Yes, just a copy of your NOA1 and the new, signed form will do. I believe that's what user KiwiBird did. You might want to ask her for details on how she attached everything. Don't send it to the lockbox, send it to the service center that it got forwarded to. Vermont or California.

Again, there's no guarantee it will ever get matched up to your petition. But I guess there's no harm in trying! :)

Since you didn't take our first offer of advise to go through everything carefully and take your time, I think you should wait for the package to come back and make sure there aren't any other errors. Everything should be done in slow, calm, logical steps if you don't want to worry or have the hassle of an RFE letter later. Even when doing it right you'll still be worried about a mistake. Try and take your time and do it right the first time.

Since you didn't take our first offer of advise to go through everything carefully and take your time, I think you should wait for the package to come back and make sure there aren't any other errors. Everything should be done in slow, calm, logical steps if you don't want to worry or have the hassle of an RFE letter later. Even when doing it right you'll still be worried about a mistake. Try and take your time and do it right the first time.

The OP can not go back in time and "do everything right the first time".
