That is just utter rubbish.

I hope the OP is weeding through all of this without somehow getting confused about what she should do. I'd re-read Darnell's first post in this thread and go that route.

Since you've not filed AOS yet - you've not sent in the I-864, right ?

Some suggestions.

1. Call ICE (# below), tell them that he's left, and you are filing for divorce, with no intention of further sponsership. This will start a national casefile, but it's tedious to 'get things into it'.

2. Get an INFOPASS appointment for your local USCIS office, and let them know you are filing for divorce, and tell them the circumstances of why you are not filing the AOS package with him. This will start a local case file. While yer there - ask to speak to the Head of Section for BOTH 'Fraud Prevention' and 'ICE' and make sure that casefiles are started in both sections. At some point, these two casefiles will rbe married up together, and sent off to the National Office

3. SEND A POSTAL LETTER to the USCIS office closest to where he is living, explain all, ask that a casefile be started in the local ICE unit and local Fraud Prevention Unit.

4. SEND A POSTAL LETTER to the Embassy IV Unit where he interviewed, explain all, let them know that he came in on a K-1 visa with fraudulent intent.

None of this stuff is automatic or in real time. It takes time, energy, and patience (on your part) to get the ball rolling. Once the ball is rolling, it will roll hard when next he is found (traffic stop, drunk and disorderly charge, etc). The 'national pick up order' will be issued to all local law enforcement, but he won't just be casually picked up, he'll have to be stopped on something else first. At some point, the locals will turn him over to ICE, and then they'll actually do something with him, based on the contents of the casefiles that you got started.

Just to be clear - YOU can't get him deported, only ICE and DHS can do that - the most you can do is make sure that the casefiles (plural) are full of evidence of his fraud. Practice writing letters of attestation, you'll need these for the casefiles.

To OP... This is SOLID advice! I can say from experience having a similar situation as yours happen to me last year. I'm sorry to hear that this happens to people and that others use love and emotions to trick decent people into these situations. I can tell you that calling ICE will be the most difficult thing to do in your life because you obviously are in love and seem to be an honest/caring person. What you need to have sink into your mind, it takes time... trust me, but realize that this guy didn't love you (don't keep telling yourself he does). Anyone that treats their spouse like that is not in love. You were used to gain an immigration benefit. That's EXACTLY what the ICE Agent told me about my situation! The ICE Agent told me to forget my ex and move on with my life as she's now USCIS's problem and they will take care of her when she comes on the grid. ICE told me to not have any contact with my ex and to inform them if she ever attempts to contact me. It's been nearly a year since I reported her to ICE and it's been 6 months since the final divorce papers were sent to ICE. She's still here in the US, even ICE said that girl was not too bright. I have heard (her aunt txt msgs me occasional updates..not sure why) that my ex is living in San Diego, using a fake ID and is pregnant for her unemployed boyfriend. It does give me a chuckle to hear things are going so well for her :no: . It takes time, but you need to seriously realize that you were used for a piece of paper to get into the USA, nothing more,,, move on with your life. There's men out there who will treat you with respect and honor. The guy you married ain't one of them.

As Darnell pointed out. You can't get him deported but DON'T file AOS and DON'T sponsor his I-864. Contact ICE to get the liability away from you! Make him a USCIS problem, not your problem. If he's drinking/driving and clubbing, maybe fighting. Chances are at some point in time he'll be picked up by local police during an "instance of convenience" as the ICE Agent told me. They don't really go after these types for immigration fraud but just wait for them to pop up in the grid (arrested, in hospital, accident, etc.). If he has a deportation order on his head then he goes back home compliments of Uncle Sam.

Whoooo ~Huge Sigh~ So very sorry you are going through this.....

I agree with maybe holding off on calling USCIS just yet (but have their # handy). I think you should be real clear about what exactly is going on because once you put any kind of indication that their is fraud going on there is NO turning back from it and it will just hurt your case in the long run if you decide to stick it out. Also, if it was me and my Hubby was feeling his self then I would def go and see for myself. I think if you can see with your own two eyes instead on the phone then that can provide some type of closure. After yall sort it all out rather thats done during your FL visit or when he gets his happy a** back to Oregon then you will have more of a clear head about how you can handle this situation not being solely based on raw emotions.

In closing, you should clown his dumb a**! I for one HATE liars and deceivers but what I hate more is a BAD deceiver. Like if your going to "con" me or whatever hell let the ink dry on the da*n marriage cert first! :angry: I mean come on thats all it took was a lil "freedom" for true colors to show. Da*n, I'd hate to see if he never had a vacation for years; boy he'd be buck-wild! See know Im mad and I dont even know him, but just the thought of someone taking someone's heart, love, generousity, care and concern then take it as a sign that your weak! Well sister, dry your tears, get to FL and see what the he*l is so da*n fascinating that he is stupid enough to jeopardize you, your marriage and immigration. Tell him you ain't worried I can't be deported, B!

Ok thats it ,I have learnt this when ever their is a lovers fight, if we cannot say good do not say bad because every pillow have its memories and if she decides to forgive him and get on with it, just remember you called the woman man dog. She did not ask you to describe him she only ask for advice. You too out of order no need for name calling.

Lets review. This women brings this man? to the USA to begin a new life based on mutual respect & love. She marries him. While she is out looking for a new house for them he takes a run to Florida to have a little Jamacian culture. That turned out to be another womem. I guess he changed pillows while working on a few new memories. He left his wife, his life, his responcibilities, his promises & his legal status.

Your advice is to find a way in her heart to forgive. Just accept the idea & concept that this is acceptable. Get over it & lay her head down on that pillow & dream of the good old days. It is probably her fault anyway. I mean she could now try to do the AOS even though his actions caused him to be out of status. She could pay the fees. Of course she would have to save for new pillows & buy an extra one for the G F.

He isnt a dog. I errored. He is a pig. He isnt her man either if you measure by your pillow standards.
