DCF in Seoul, What if wife moves back to PI?

Well My wifes I-130 is taking longer than I thought. Everyone over here I have talked to got their visa, start to finish, in as little as 2.5 to 3 months. Its been almost 3 months and my I-130 hasn't even been approved. The only thing I can get outta the Embassy is they are still waiting on document Varification from the Philippines and they have been waiting for a month for that. So its almost March and I leave 5 April back to the states. If the I-130 hasn't been approved by then, what would happen if my wife moved back to the Philippines? Would she be able to finish the process there? Would she have to start the process over?

You don't give the details of 'why here.. is there some reason your wife can not stay in Korea after you leave? Something about her visa for there maybe...?

Unfortunately, this is a downside to a third country case.. her docs needing verification etc.

From the Consulate's point of view, it's OK with them that your wife stay there without you. What Korea has to say about it is another thing.

Ideally, I'd think you would want to keep your I-130 in Seoul, and if at all possible, the visa app too. Wait times for an Immigrant Visa interview in Manila are +6 months right now and getting longer.

Aren't you working with the USCIS Field Office in Seoul? Or is that what you mean by 'the Embassy'?

We'll I am in the Military, and won't be able to bring my 6 month old son back to the states with me, so when I will leave she will lose access to all the base services. Someone will have to sign her on base, she won't be able to go shopping for food or other ammenities. She won't be able to goto the hospital if something happens to her or my son. Also her Visa here well no longer be good after I leave since she will no longer fall under sofa status. She will have to get a tourist visa, and I believe that is only good for 90 days.

And yes, when I said Embassy, I went the CIS Office.

The tourist visa is only good for 90 days, yes. Trying extending her in bids. I did that and they extended it for two years right up to 2008. So I can get access to post at all times, even though my husband is back stateside. May be different for you, we're army, but then again maybe not. Hope it all goes well, don't loose hope, the I-130 maybe approved any day now, they are pretty good about it, also I wouldn't take just one person word for things in DHS. I found that there is a tendency to often get conflicting information. The best time to call and get the guy there that really seems to know what he's talking about would be about 8:30am. Well after finding some things out concerning financial issues, I will not be able to keep my wife here in korea if her I-130 isn't approved by mid-march...After that she will most likely have to move back to the Philippines around the first of April while I go onto the states. Since I filed her petition at the CIS office here in Seoul, Korea. How will that affect things? How would I go about transferring it to Manila?
