Hi dear friends,

I'm a new member of this forum and very glad to meet you all here. I'm not familiar with the K1 process, so I want to ask some stupid questions.

My fiance's lawyer sent his I129F to Chicago. But I think the application should be sent to VSC rather than Chicago according to his jurisdiction. Is the address wrong? Also, I'm Chinese but currently reside in Canada. If the petition is approved, will I be interviewed in Canada or in China? Where can I find a checklist of documents needed for the interview? Welcome to VJ, first we need you to please fill in your timeline so we can get an idea about your situation. Where does your Fiance live? No matter where he/she lives I don't think it should have been sent to chicago. Your interview will be held in Canada, because that is your place of Residence. You may want to post a question in the Regional Forums as to more questions regarding the checklist.

1/13/06 TSC rec'd

1/23/06 NOA1 from CSC

1/27/06 - Check cleared

7/10/06 - NOA2

7/14/06- rec'd @ NVC

8/14/06- NVC sent petition to Consulate

8/17/06 - Korean Consulate rec'd Petition

8/23/06 - rec'd packet 3 from Consulate

8/25/06 - sent packet 3 back to Consulate

8/27/06 - got confirmation email from Consulate, they rec'd packet three

8/27/06 - requested interview date via Consulate internet site.

9/1/06 - Checked internet site for interveiw date, it was there

9/25/06 - Interview date - APPROVED

9/28/06 - Visa in Zaeems Hand - YEAHHHHH

1/6/07 - leaving for USA

1/20/07 - Wedding Date

1/20/07 - MARRIED!!!!!

2/10/07 - rec'd certified copy of marriage license

AOS

3/13/07 - AOS package rec'd at Chicago Lockbox

3/20/07 - Rec'd Social Security Card

3/21/07 - Checks Cashed and Case Status online

3/24/07 - NOA1 Rec'd for AOS and EAD

3/27/07 - rec'd Biometrics appt letter - scheduled for 4/20/07 @ 11:00am

4/02/07 - "touched"

4/20/07 - had biometrics appt.

4/21/07 - rec'd letter stating case was transferred to CSC

5/22/07 - rec'd Case Pending at CSC email

6/25/07 - EAD card production ordered

7/7/07 - EAD "touched"

7/7/07 - AOS "touched"

8-6-07 - Rec'd EAD Card in the Mail

5-20-08 - AOS INTERVIEW - APPROVED - PASSPORT STAMPED

7-2-10 - Received 10 year green card in mail

Timeline

The K1 should not have been sent to Chicago. It should've gone to Vermont, California, Nebraska or Texas, based on where the USC lives. This is also pretty clear on the instructions as well as the USCIS website.

I am also knew, but i think i know what your lawyer did wrong...

I think he sent your I-129F like it was an application for a spouse K-3 visa, and not for fiance K-1 visa...

I m saying this because i also filed for I-129F/fiance petition , but i filed for it in the Nebraska service center, because that is the service center that takes petition applications from my state, Missouri....

However, that petition was denied, we then married in england, and filed I-130 , and I-129F /spouse K-3, which the application for the I-129F K3 had to be mailed to Chicago, IL, like you are saying your lawyer did.

the service center you should have your I-129F mailed to depends on the State that your fiance is a resident in... --Filing the Petition--

"You must file the Petition for Alien Fiancé(e), Form I-129F, with the Department of Homeland Security's U.S. Citizenship and Immigration Services (USCIS) office that serves the area where you live. See the Department of Homeland Security's USCIS Field Offices for information on where you can file the petition. Note: You cannot file this petition at an embassy, consulate or U.S. immigration office abroad. "

O yeah, and i had a lawyer to , helping me with my AOS, and he told me that i didn't need to include proof of employment, that those instructions from the NVC were out dated, and he was so wrong...so you can't always trust them...

The thing is you will have to fill out your profile data more, and also start a time line.

You can see from my profile a lot about me and my Chinese fiance.

A few questions, are you a Canadian citizen or just visiting Canada from Taiwan, Hong Kong, or mainland China?

Are you married to your Significant other or Engaged?

More detail will help us all with answering your questions.

The OP said mentioned a fiance and I-129f. So... engaged to an American citizen.

From the instructions on I-129f:

If you are filing for your fiancé(e), submit this petition according to your place of residence, as listed below:

12. Where Should You File This Form?

A. If you live in Connecticut, Delaware, District of Columbia, Maine, Maryland, Massachusetts, New Hampshire, New Jersey, New York, Pennsylvania, Puerto Rico, Rhode Island, Vermont, U.S. Virgin Islands, Virginia or West Virginia, mail this petition to:

USCIS Vermont Service Center

75 Lower Welden Street

St. Albans, VT 05479-0001

If you're a permanent resident in Canada, even if not Canadian, I guess you can have the interview in Canada. Anyone?

I'm not positive on the info I gave you, as I didn't research. I just remembered having read about it. Maybe someone else will clarify that.

I guess you could call USCIS and ask them what to do. It's weird that Chicago's issued a NOA1 as it seems the petition should've sent to VSC.

The fact that Chicago issued a NOA-1 is peculiar indeed. Do you have the paper NOA-1 (form I-797) yet?

If so, look at the address on the bottom, to ensure it was issued from Chicago. They might have transferred it already.

If not, you can try to call. History has shown that a call to USCIS yields little useful information.
