on W7 form I see just one block to sign in the Sign Here area

Signature of Applicant (if delegate , see instruction)

Name of delegate , if applicable (type or print)

So how can we both sign , as you suggested?

I know in the Tax we both need to sign. I am just asking who needs to sign on the W7 form. (Just to make it clear what I want to know)

Your spouse will sign it unless you have your wife fill out the 2848, Read on page 5 of the instructions here: http://www.irs.gov/pub/irs-pdf/iw7.pdf

It would be best if you just e-mailed it to your spouse and have her print and sign, then send it back to you IMO though.

Removal of conditions Journey

16 March 2012 Sent I-751 package from Aviano AB, Italy.

29 March 2012 Received everything back...wrong fee. thought we didn't have to pay biometrics since we were sending fingerprint cards and passport photos.

30 March 2012 Sent everything out again from Aviano AB, Italy.

10 April 2012 Check cashed

17 April 2012 Received NOA1 dated 6 April.

06 Dec 2012 Received 10 yr green card. Letter said it was approved 28 November 2012.

Timeline

Alien spouse signs the paper. If you are filing your tax papers married filing jointly than I suggest you do the following:

1: You need to have a notarized copy of a passport bio page or other forms of ID that is acceptable by the IRS. It has to be notarized in the U.S.A. or a consulate.

2: Completed W7 with the alien spouse signature cause he or she is the one applying for an ITIN number.

3. If the alien spouse has income in his or her country than complete Form 2555 or 2555EZ Foreign Earned Income Exclusion so that you can deduct the earnings up to $91,500 from the 1040 that you are filing married jointly.

4. Write a letter telling the IRS that you want your spouse to be treated as a U.S. Resident for the 2010 tax year and have both of you sign the letter.

After you have everyhting in hand. Put the W7 on top of the pile with notarized ID, letter, 255 than the 1040 and send it to the following address.

Take the documents to them and they will verify everything is proper and request the ITIN for you. Just want to be clear that their are options other than Austin.

Thanks for adding that, yes, thats another option. And I forgot to mention that the foreign earned income is in foreign currency, so that one must convert that to U.S. Dollars. And IRS has know how you came up with that so you need to show the calculation with the conversion rate of that time.

Although this whole process seems diffucult and confusing. Once you get the hang of it its easy.

How does one go about doing their state taxes if their wife doesn't have an SSN? Do they need to request an extension and use the ITIN they receive from the IRS? How are you all doing your state taxes? Thank you.
