hi,

when I traveled to the states I always got an I-94 form from the flight attendant. But not this time. I flew in from germany to chicago, and they told me I dont need one, even the border patrol agent didnt ask for it, he just put a stamp in my passport with the arrival date and the expiration date. Now i got married to a U.S. citizen. and we are filing I-485,I-130,I-693,I-864. G-325A and I-765, Almost every single form asks for an I-94 number, but I dont have one... what should I do?

Make a copy of the passport page that contains the stamp you received when you entered and include a statement that you were not given a I-94. Make a copy of the visa as well.

These are my best suggestions. If others have been in this situation before, they can probably offer better suggestions or an entirely different course of action.

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

You entered on the Visa Waiver Program. VWP never got a I-94, but rather an I-94W. Now everything is electronic. When did you enter in the VWP? Lately, people who overstay VWP and try to AOS have been having problems, and possible denial, though signs may be looking up. Nothing is definite. Even if you don't overstay, if your AOS is denied, you will have no chance at appeal. Also, if you entered with the intent to immigrate, that is visa fraud.

Indeed, they no longer have I-94's. All you have now is a stamp in your passport. Since many forms ask for the I-94 (or the number on it), you don't have a document with the required information. I simply wrote "n/a" and "Visa Waiver Program" in the space provided. I doubt you need to write an explanation since this policy has been in place for quite a while now.

Make sure that you make a copy of that stamp and include it with your package. If you don't, you will receive an RFE that request you to show that you entered the US legally.
