Hello, I am the daughter, of a daughter of a US Citizen that was petitioned for in 1994. My Grandpa petitioned for my mom as "Unmarried Daughter with Children".Our application was "accepted" in Feb of '95 and have since been waiting on the GC. I have a valid SS# and a valid Work Permit I-765. I am now 25years old and was told by an attorney that I can no longer file under my mother as I am "of age". I was told that my mother has to become a Citizen because thats the only way she could petition for me. My mother insists that NO!! Since I was "accepted" under her application I am "still in the process" under her petition that my grandfather made. If anyone has any answers please help me with citations, websites or any information you may have. Thank You -Lily

May want to update your profile as you're nowhere near Naturalization pending.

F2B for Mexico is another 2 years away from your PD: 15JUL92

You MAY have a CSPA claim depending how long it took USCIS to adjudicate the petition so you can "shave" that amount of time off your real age.

What's the work visa you're currently on? Any chance employers could sponsor your for perm residency?

ROC 2009
Naturalization 2010

I´m afraid your lawyer is right. You were considered to be a derivative beneficiary of your mother´s F2B while you were a minor, but because you are over 21 you have aged out.

Once your mother becomes a LPR she can petition for you under same category F2B, assuming you are single, but Mexico is an oversubscribed country and the PD for that and most other categories available to you are backlogged way back to the 90´s … and you already now how that works… it´s ridiculous to have to wait that much time!

F2A 01-jul-06

F2B 15-jul-92

F3 08-nov-92

F4 01-feb-96

So may be your real option is : GC based on marriage! Love can save you!

Thank you for that i did change it I just didn't know what to put as a status and no no chance my employer could do it. I don't think i haven't asked. But I am almost positive it won't work. My Employment Authorization Card has a number I-766 Rev. (05-2004) my social security says "Valid for Work Purposes Only with INS Authorization". What is "F2B"? Sorry I ask so many questions but my mother for a long time prohibited me from medling in this business. But i was told by the attorney I consulted with that I am at wits end and I have to do for myself now!! :/

HAHAHA! Thanks for that! I was married to a Citizen at one point but not for those reasons... needless to say time passed the marriage dissolved and well no GC for me. So now I need to find out what else can be done but I was told by this atty. that that is probably my best option. 20 years and i graduated top of my class... No criminal Record... No fraud... No anything... Been legally paying my taxes and a stable job for 8 years. I'm just very frustrated now. Could you tell me where you got the dates and what they mean please.

Good thing is that you´re taking this matter in your hands. First thing you need to do is to educate yourself! … check out the guides at the top of the forum and read everything you find about the immigration process… Please don´t lose faith… I´m sure you will find the way.

The dates come from the Visa Bulletin :
