IR1/CR1 OR K1 ???

hi visa journey freinds

i hope i can get some advice about this

me and my fiancee american we plan get marry in morocco , but we have issue with money and place for stay if they agree go there and aslo too much pay in credits cards, my worry is marry here and then have not enough support and house or rent for they approve us then we will stuck far apart , we need help

what choise K1 or CR1

what positive for our case

please help

If you plan to marry in Morrocco - you cannot use the K1, you would have to do the CR-1.

So you would need to determine where you want to get married.

You will also have to be able to meet the requirements for the I-864 - do you? (well - the USC will have too)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Well as you have no time line and it says here you have applied for CR1 which is cheaper than K1 but takes about the same time. If you marry in Morocco then she will have to come back to the states and file CR1 which yes means you will be apart. If you go K1 route then you wait till petition is approved and she comes to US and you marry but then you have the cost of AOS $1070 to pay for Green Card, Just to make sure you can't have 2 petitions going at the same time so I am assuming you have not started anything yet? For both petitions USC has to show they can support you here in the US. SO if you are having financial problems now I don't know how you will manage with the petition fees.

yep she is us citezen we will be soon in morocco 20 april. lol

You're going to have fees to pay either way, and if she cannot provide support for you, then she'll have to find someone else willing to do that (for both visa types).

As was stated above, it really just depends on where you wish to marry. If in the US, go for a K1; if in Morocco or another country, CR1. Decide that first and then worry about the immigration process.

The K1 is more expensive, and the CR-1 means you can work as soon as you get to the USA, so I would recommend getting married and filing for the spousal visa.

However, your US partner will have to be able to financially support you to get the visa no matter which visa you apply for, or get a co-sponsor.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

The fee for the 129f petition is $340 paid by USC . She will have to be here and have income from a job to show that she can support you once you get approved with a K1 visa. Then you have costs of medical and police report and visa costs in your country. CR1 same costs more but you don't have to AOS after but you will be spending time apart regardless whatever you do.

Well the costs for medicals and police report and visa are all different in every country. So you would have to check that on US consulate site in Morocco. For me it costs and this was last year ok, 129f petition was $455, my medical in Australia $185 Aus dollars ok blood test cost me $45 Xray $60 I think, Police report was $157 so it all adds up. SO If she can pay the petition fee or you can help her then great and if you can cover your costs in Morocco that will help her pay some of her debt off.

So the longer she is in USA and paying her bills and getting some income she will be able to support you financially to get here. SHe has to fill in affadavit I-134 for to show that she has enough income and if not will need a co sponsor.
