My adjustment of status case was pending almost more than 1.5 years and now when i followed up with USCIS they just said below ..... anyone knows if this is general email or will there be second interview scheduled? how long i should after receiving their email?

The status of this service request is:

Your case is pending scheduling. You will be sent a letter notifying you of your appointment date within 60 days.

Yes, i had interview 1.6 years back and now they sent this reply but still after 60 days no interview scheduled.

Do you know how long they take to schedule interview after sending this reply? is anyone in same situation?

I'm sorry but would you mind telling me why your AOS has been pending for such a long time ? I thought it just could take up to 60 days to inform you the result whether to be approved or denied after the first interview.

11/8/10: Medical exam

11/12/10:Get married

11/19/10: I-693 sealed.It means my chest x ray is fine :)

11/20/10: Package [ I-130,I-485,I-765] sent to Lockbox

11/22/10 [Day 1]: Delivered there

11/29/10 [Day 7]: Return receipt from USPS

12/13/10 [Day 21]: Texts and email received [ after 21 days!!!!!!!!!!!!!!]

12/16/10 [Day 24]: Snail copy received

12/18/10 [Day 26]: Every single form touched

12/20/10 [Day 28]: Biometrics letter received

1/13/11 [Day 51]: Biometrics done

1/24/11 [Day 62]: Biometrcis appointment received AGAIN.!!!!!!!!!I was like #######

2/04/11 [Day 72]: Second biometrics done

There is a chAnce some issues arose either during your interview or after your interview but before a decision was made. It is likely your case had been transferred to the investigative arm of uscis and they are actively conducting field investigations. Whatever triggered these investigations you'll likely never be told, and what happens next will be unknown until uscis makes their next move. The only advice I can give you is to be prepared and to have your evidence in place.

I had my interview in june 2007. My wife went to interview and we had our two kids also. I was asked for Medical exam and I864. That I provided same week. I didnot get reply till may2009. I went back and enquire and ask why I am still waiting, Then I was called for second interview with notion that interview will be taped etc etc. My wife didnot go, I went alone. Officer told me that my I130 was withdrawn by my wife, and denied my AOS. Then Within 2 months Removal proceedings started. I filed VAWA and . its approved. Now I have my fingerprint date set on March 30th.

All I,m saying is there must be something that trigger the hold on the case, it can be anything, including but not limited to, Spousal complaint, withdrawn petition, security check, doubt of sham marriage, or incomplete application, criminal record etc. can be file lost too.

May 26th, 2009 : WAVA filed.

June 1st, 2009 : RFE issued Good moral: replied june 15th 2009

July,17 2009 : Prima facie approvel received.renewed again march 3, 2010

February 2, 2010 :I-765 filed, : denied

August 12,2010 :RFE issued on WAVA, more evidence needed.

sept 3rd 2010 : I-765 filed again. 9/15/2010:Filing receipt received.

Sept 15,2010 : REF answered with all evidences.9/17/2010:RFE recvd by USCIS.

Sept 19, 2010 : I 765 approved.

Sept 19,2010 : I360 touched. status changed to RFE Under review.

sept 20th 2010 : I 765 card production ordered, No Biometric, no picture etc.

sept 21 2010 : I 765 touched, still card in production.

Sept 22,2010 : I-765 touched, Card in production.

Sept 23, 2010 : I765, touched, Approval letter mailed. Card approved (???)

Contact them again, yes. And if you do not hear back from them within a week, or you do not get more information other than you already have, then contact your Senators' or Congressman's Offices and ask them to find out what is going on. You will need to fill out a permission form that authorizes them to check on your behalf, but this shouldn't be difficult. Most Senators and Congressmen have the permission form on their websites so you would print it out, sign it and then either mail, deliver or fax it back to them. You can follow up with a phone call to their office and make sure they receive it.

My AOS took 22 months to be approved - no explanations, no responses through USCIS, no nothing. When I finally sent an email to the Service Center asking why the delay, I got a response back that the 'security checks' were completed, followed within the week with an approval. I strongly suspect that the application had got 'lost' sitting on someone 's desk for many months (since my second biometrics) and that my email to the Service Center 'shook it lose' . Contacting USCIS by phone certainly did nothing. (heheh, I should have waited 3 more weeks - the approval came 3 weeks prior to our 2nd anniversary so I still had to file ROC).

Good luck to you - you should definitely have had some sort of more definitive answer by now.

It seems that you file for VAWA after you were place on removal proceeding, I would recommend a lawyer in your case. Also why did you file VAWA for after your wife decide not to support you anymore, this is not abuse.

It seems that you file for VAWA after you were place on removal proceeding, I would recommend a lawyer in your case. Also why did you file VAWA for after your wife decide not to support you anymore, this is not abuse.

This is why USCIS is giving you a hard time cause you file VAWA after removal proceeding had begun.

I completely agree to you Katie. This is a perfect example where half knowledge can prove dangerous, it happens when a lay person handles a complicated case without a lawyer only to shoot themselves in the foot. Many a times simple cases become complex because of half knowledge. At the end simple turned complex cases are expensive to repair.

That not the reason, USCIS given me hard time because they lost my A file. even if the VAWA filed after the removal proceedings, ITs still a VAWA and ITs approved. Case was terminated after filing I485. USCIS don't want to creat T-file ITs a lot of work, that why they tok short cut and open remival proceedings. Now court did create T-file and Remand case back to USCIS. IT should be no problem anymore.

No matter what I don't want to get attorney, I will rep myself I did in the past , in the court. I don't care anymore because I had three Attorney in the past who just took the money and did nothing. Finally I did everything myself including joint motion. I guess I am at the stage where I know What to do in my case and more. I also Did FOIA myself that where I found My file was lost, I 130 withdrawn etc.

May 26th, 2009 : WAVA filed.

June 1st, 2009 : RFE issued Good moral: replied june 15th 2009
