Okay guys, I have this friend who's been in the USA for many years. He first came here for undergraduate at Columbia on a F1, and while at school, he got his Social Security Card WITHOUT any restrictions on it! So he went to work at Walmart...restaurants...places...then he graduated and was sponsored for H1B for while, then he quit his job and started doing MBA at UPenn, which meant he went back on F1 again! And he's been working with his without-any-restriction SS just like an average American citizen! I tried to warned him about how risky it is.....

You guys think he might get into deep ###### later years?

I'm actually pretty jealous of him! HA! He told me to look for a job too, since I have SSN, and he said not all employers actually required you to show your card, they just want to know the number...besides, he said employers don't know much about US immigration, visa laws...

YEA I KNOW! He used to work for some restaurant, and Walmart, now he's working at Bestbuy and get paid for 30 bucks an hour!! I am so so so jealous!

E-Verify only shows current status, so if he's 'in status' with current student visa, it'll pop up.

Should he try to adjust status again, say to some permanent resident thing with a green card - his prior 'things' will pop up, and then during the adjudication process action will be taken.

What that action is - is detailed in some regs and manuals - so I'll leave it to you to find it, make yer buddy aware.

I don't have to research for him, it's his problem anyway, I'm not willing risk my status to do what he's doing. Actually I always tell him he should be aware that when he applies for green card, they might check his employment history in the country. Well I guess he's just lucky or whatever.

I'm more curious why he got his SSC that has NO restrictions on it, mine says VALID FOR EMPLOYMENT WITH DHS AUTHORIZATION ONLY.

If his card has no restrictions that sounds like the problem of the US govt. They assert that they don't make mistakes. My father's age? They added five years when he emigrated and 40 years later they say that the age on file is his age.. OK! that's it!

So while it is troubling, if he was delivered a restriction-free SS# he might just need a good lawyer.

Nope that would not work, if he is ever caught. If he plans to return back to his home country he might be ok and might never come up, but if he files for GC or something past employment would show up and might be asked questions about it.

He is very well aware that he is not allowed to work yet he is working, as most schools require students to attend the orientation and they clearly talk about this in orientation.

Just coz govt made mistake does not get him "free get out of jail card" sorry it does not work that way.

Latest update...he got a job offer from the Boston Consulting Group, salary is more than 100K USD, with H1B sponsorship,and BCG even promised him to sponsor for the green card within 2 years.

Well, I guess the US government really loves smart people, and they might give him a break.

If he is lucky he might slip thru cracks, but his past employment would come up during his GC process.

BCG is consulting so just dont get hopes that if they promise right now that they will file for his GC means they will....lol
