So here is my story, my husband and I married on 11/25/09. We are in the proces of putting in his AOS. My question is I recently had to leave my job due to some health issues. I am going to be working part time but we are going to be taking a big paycut. Now my husband works here and there but nothing to really support us. I was wondering since my daughter and I are both U.S. citizens if we could apply for public assistance (TANF cash/Food Stamps) and if that would affect his AOS as we just sent it out. Once he gets his work authorization he has a job lined up but till then we are living day by day and I physically can't work anymore. Please someone help!

07/05/2008 Met at a concert

01/01/2009 We are engaged at midnight!!!

05/31/2009 I make the move to NYC and move in with him.

09/27/2009 Find out we are expecting!

11/25/2009 We are married!!

05/04/2010 Our beautiful baby girl is born!

03/17/2011 AOS package sent

03/18/2011 Package recieved signed by R. Mercado

03/22/2011 Email/Text NOA1

03/24/2011 Touched

03/31/2011 RFE for medical (Dr filled out expired form >:[

04/16/2011 RFE sent back

04/18/2011 NOA for RFE recieved form

04/15/2011 Biometrics Letter Recieved

04/18/2011 Walk In Biometrics unsucessful :( (Woodside NY)

05/16/2011 Biometrics

05/24/2011 Email approve EAD and card production

05/27/2011 EAD arrived

05/28/2011 Apply SSN

02/02/2011 Recieved SSN

waiting on interview :(

1) You and your daughter can accept the Government Assistance.

2) You cannot claim the assistance as income towards your AOS (I-864)

3) You need to locate and prepare all necessary papers for a joint sponsor.

So if I have a joint sponsor (which I do) it should be ok as long as my husband doesn't apply also. I know they count his income but they don't count him as part of the household. By basically as long as I have a joint sponsor it should be fine for myself and my daughter to get some temporary assistance.
