New petition, new partner!

Hi all,

Well, maybe someone can help me with this...can I file for my soon to be husband eventhough I once filed for a fiance (things didn't work between us before he entered the US) in the past two years? The petition was not found at the NVC or w/ immigration. The embassy has been closed or not available via phone. Will USCIS deny my new petition for present hubby?

ANY advise would be appreciated! Thanks!!

Yes, thanks Mex. A closer read says - 2 or more filed at any time or 1 approved in the last two years... but we don't know the clear status of her 1st petition since it has not been located... guess the OP will find out if she tries to apply w/o a waiver.

I was the sponsor(fiancee), US born while my fiance was approved by NVC-the package was sent to the embassy but nothing else occurred. It was a blessing given my ex-fiance and I grew apart and so ended our relationship. Now, I'm in a new relationship with present fiance and will marry. He is in the US on a tourist visa. I will end up filing for him. Hope this clarifies things!

Oh yeah,

I will petition after we marry in the US. He will probably stay here with me too while awaiting further

instruction from USCIS once the petition is filed.

For clarity, the ex-fiance'f files are or may no longer exist at the embassy. This has been over a year now and they consider it closed since he did not respond to any of their requests. Even I could not find him after a period of time. That's really what ended the relationship. We were not strangers and grew up in the same neighborhood. I moved on.

New beau is a MD, widower and was an ex until we decided to rekindle our relationship from prior his departure to medical school. Now, we want to continue towards a life together; looking towards a real future together. His a kind gentleman, a friend and we always kept in touch throughout the years. We did not plan for a relationship-but we are happy we gave it a chance. Now, as our wedding is approaching,

I wanted to look towards making everything legal so there are no complications in the future. GIven I will be married with him regardless of USCIS, just wanted to know which route to take in light of my particular situation. Hope this clears the air...and makes more sense to all.

So what form are you actually planning to submit? It's not a K1... and not a K3... are you just planning to adjust status then?

Now that we're talking about an AOS and not a K-visa, I'm not sure. I will defer to someone more knowledgeable than me....

I'm sure you know, though, that he cannot leave the country while the AOS is in process.

The muddy water is getting more clear! I wish you luck, and hope some other members can provide more help. Seeing as how you submitted a petition for a fiance visa in the past, there may be some question about the reason for your current fiance coming to visit the US. His intent could not have been for the purpose of getting married.

You may want to contact an immigration attourney about this. A consultation certainly couldn't hurt.

If it will affect or not, i'm not a lawyer. But, of what i understood, your ex-fiancée was absent, you were not esponsible for that i would think. I remember of little knowledge i have that they offer we add a sheet where to explain the situation if it seems more complex. I would write briefly and concentrated to the facts what happened your story, as you put it here and on an additional sheet. This, in the case you would not see a lawyer, but I would ask one just in case.Oh! and i forgott the Infopass appt. that might help!! Good luck with your new relationship! (F)

To mid July-07 - I-864 form sent completed and IV fee bill

19-July-07 NVC rcv I-864 form; mail signature rcvd.

22-Aug-07 Ds-230 with documents sent to NVC.

20-Sep - 07 Alien sends NVC Missing document. NVC receives it the 25th.

05-Oct - 07 NVC completed.

16-Jan - 08 Interview, 3 questions asked, visa approved same day, received 1week later approx.

Note: delay due to internal delay, missing document (not rfe) and self procrastination of understanding some abstract terms. C Post not at all reliable (delivery duration, delivery with signature (did not deliver personnaly), and delivery of interview letter rcvd after the interview).
