Hello All,

My friend got married abt 2 years ago to non-citizen of USA, and when she applied for k3 there was req. to live with the spouse for 90 days before they can apply for visa.. Is that requirement still there? let me know

I don't know who is what in your story but I have a feeling that you're talking about filing in Delhi. If so, that option is only available to USCs who LIVE in India now.

I am a US citizen, and my boyfriend is not. We are debating abt Fiance/Marriage visa..

Seems that Marriage visa is easier, and faster to process..

Anyways, My friend filed her application in Delhi and she had to show a proof that they were together for 3months, before she could file for her spouse visa..

Yes, I am talking abt filing in Delhi..

So you know if the requirement is only for Delhi/India?

Yeah, like I guessed.. you must live in India now to qualify to file there. Look for my post in this thread: http://www.visajourney.com/forums/index.php?showtopic=28756

All the info you need is there, but you might reconsider the fiance route instead.

You think Fiancee visa would be better?

I have gotten advice, stating that K3 would be better, since we would not have to change status several time

All in all, the best thing is to get married in India, and come back here, and apply for my spouse from here.. Do you know how long it takes if I were to apply from here?
