Hello

I think I may be over thinking this I-864 affidavit of Support but I'm hoping someone can help answer a few questions. My husband and I were just married 3 weeks ago, brought him over with I-129F.

Part 1

1. Since I am petitioner and have taken his name on marriage cert do I enter my new married name?

and is box A the correct box to check? I am the petitioner. I filed or am filing for a immigration of my relative.

No other letters listed make since to me.

Part 2

3. Do I enter my address since my husband is now living with me or do I enter his old address in the UK?

Part 4

15. Country of Domicile? Help please... do I enter US or UK for him?

Part 5

21. c. I am not married but husband I am sponsoring in line a. do I leave line c blank?

And line d. dependent children... I have a daughter that is 19 but living at home. do I list her or leave her out of the count. I do claim her on taxes for college reasons.

Thanks for any help you can give. Again I hope I am just over reading this but I want to make sure this is right.

Put your married name, the address where the two of you currently live, and domicile would of course be US since this is where you are living.

For your daughter, since you claim her as a dependent on taxes and she lives with you I think you'd need to put her on the form. Someone else may be able to say more definitively.

How about Debbie MaidenName LastName since your income proof may be in the maiden name. You are petitioner.

Part 2

3. Do I enter my address since my husband is now living with me or do I enter his old address in the UK?

Part 2 is about him. He lives at your house now. Put that.

Part 4

Part 4 is info on the sponsor (YOU). Where do you live?

Part 5

C is blank. Daughter is counted.

Agree with Nich-Nick on everything except the first question about the name. Write your married name. It is irrelevant that your info might be in your maiden name, just like it's irrelevant for the immigrant (if she's female) 'cause they have all your info from the k1 so they know you're you. If it's not you LEGAL name, don't write it... meaning unless you actually kept your maiden name in some form (as a middle name or hyphenated last name etc) then don't write it.

Agree with Nich-Nick on everything except the first question about the name. Write your married name. It is irrelevant that your info might be in your maiden name, just like it's irrelevant for the immigrant (if she's female) 'cause they have all your info from the k1 so they know you're you. If it's not you LEGAL name, don't write it... meaning unless you actually kept your maiden name in some form (as a middle name or hyphenated last name etc) then don't write it.

I don't see a problem with including the maiden name on that form. It's one big long line. I'm not convinced that AOS bothers to go back through your K1 file to to put 2 + 2 together, especially if you add it up for them on this new process.

As far as legal name...what constitutes a "legal" name? I've got current bank accounts as Mary Ann Jones and Mary Smith Jones. My Social Security, passport, and marriage certificate are Mary Ann Jones, while drivers license and stock certificates say Mary Smith Jones. And none of those names are my British husband's name. Nobody has ever cared. I didn't purposely chhose those ways to put the name, they were just the preference of the person setting up the account/document. I think either way will be okay with USCIS.

Basically it's a legally binding contract, like buying a house. You write your LEGAL name on the forms, everyone only has ONE legal name.

While I appreciate you haven't gotten around to changing everything YOUR legal name would be Mary ANN Jones. This is because that's what your SSN says which is what everything in the US goes by. When you file taxes that's the name you need to write on your tax returns and the name you would sign. Technically you SHOULD be changing all your ID into the same name but sometimes it takes a while. Your drivers licence should be in the same name as your SSN, it's weird that it isn't because I HAD to have mine the same as my SSN... maybe it'll change come renewal time.

Anyway, if the OP is electing to change their name then they put their new LEGAL name on it because that's the name they're gunna sign.

Vanessa hon, I've been both Mary Ann Jones and Mary Smith Jones (even Mary A. Jones and Mary E. Jones) on very legal US documents since 1974. I believe 37 years using combinations of of my maiden and married name indicates it's not as big of a deal as you think with your less than a year and a half experience in the US. At this point in my life, I only need to decide what to have put on my tombstone. :unsure:
