Timeline

My joint sponsor had not filed tax returns for a few years, and now she has, I'll be able to use those copies as they meet the poverty guidelines.

However I read in the new I-864 Intsructions:

"If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support"

Therefore I have a few questions

1) I don't believe it mentions this on the older I-864 my sponsors have used (that are acceptable through 10/19/06), so will it apply?

2) If we request tax transcripts, will they have this "documentation" stating late filing? or would we need to do something else?

3) Would it be acceptable to send just the copies of tax returns and state that we will bring transcripts to the Interview?

My hubby filed late for the past few years and only did it about 1 yr previous to our filing.

We only had W2's and copies of what he submitted. We never had transcripts and were never asked for them. I don't think you are scrutinized very much concerning IRS.

They just want to see you submitted them and they will look at the totals to use for evidence of support etc.

I think you're fine, bring copies of what you have sent. That's my 2 cents.

Track down any W-2 forms if possible from employers and copy them while bringing originals with you..I filed my 2005 late because a tax person told me I needed an Taxpayer ID Number for my wife because her K-1 expired, but she couldn't get that because she is eligible for a GC and a SSN afterwards. Catch-22. I have all the documents from IRS and SSN...I sent in a copy of my original return with my wife's AOS...so they know I sent in my return to Philadelphia...Philadelphia rejected my wifes TIN request and I haven't heard anything about my own return (filed jointly) I have my W-2's from 2005 so they will get a copy of them on my wife's interview OCT 2. I'm sure they will have questions for me....I know I will have questions for them....it would be nice to get solutions...I hope you get your solution too....good luck.
