I-1864 for self-employed

I am submitting my I-864. I am self-employed and meet the income requirements taken from line 22 of my 1040. Will they eventually want other documentation besides my 1040, such as bank statements that show I am currently earning income? Also, I was not planning on filing until 4/15 since I owe, is it okay if I go ahead and send my 1040 now or should I wait until it is submitted to IRS?

Also, in 2009 I was about $2K under the guidelines. I have a savings account to make up any difference, but wasn't sure if I needed to send in that documentation since I was ok for 2010?

You should send also a letter signed by you which states that you are self employed , what you do and how much you earn

and if you have supporting docs for that

WE got an RFE because we did not send this letter in the beginning and now our case has been delayed

I would have ordered transcripts from the IRS rather than sending 1040s but in your case its a bit too late. Never submit a 1040 to NVC that you haven't already filed with the IRS. I would put the 1040 in the mail and than send NVC a copy of it.

I thought, I'm sure someone will correct me if I'm wrong, you had to be above the guidelines for all of the 3 years. I would show your bank account to be on the safe side. Also for tax year 2009 you were 2K under the guidelines and you multiply that by 5 and you had to have 10K in the bank account to cover for the difference in that year. If you did have 10K in you bank account at the end of 2009 than I would also send a statement from December of that year.

I am not 100% sure so I would suggest you call NVC and ask them to get more info.

I'd love to know the definitive answer to this, because it will determine whether we need to get a co-sponsor.

Only your current income needs to be above the requirements. Now, every Embassy is different and some are stricter in how they determine if your income is enough. That is, if you state your current income as much higher than that shown on the tax returns from the previous years, then they will want more explanation as to why, to ensure that your current income will actually continue.

If you are sending in a copy of your tax return, instead of a transcript, you will also need to send every supporting schedule.

No need for this. The I-864 itself is an affidavit signed under penalty of perjury, stating exactly that.

Don't just send the 1040. Send the complete tax return including all schedules, everything that would go in the envelope when you file the return. With only one year of qualifying self-employment income, I would state and document your liquid assets as well.

You have to write your income from the last three years (as shown on your tax returns) on the form. But you only need to send in the tax returns from all 3 years if you feel it would help your case. Any tax return you send in needs to be supported by the schedules. As you haven't filed for 2010 yet I think you should probably send in your 2009 return (and schedules) too. You probably don't need to send in the prior years unless they show that your lower income in 2009 was an anomaly. But if you do send them you will need the schedules and any W2s too.
