Hello,

I am in GA on an H4 dependent visa. The attorney forgot to file for an H4 extension along with my spouse's H1B(premium) extension. My spouse got her H1B last week while my H4 extension has just been applied, today . Problem is my I94 is expiring on March 20. I am unable to get an extension for my drivers license which expires on the same day(March 20) as the DMV insists on a valid I-94. The H4 extension approval can take anywhere between 3-8 months. What can I do? Any suggestions would be helpful.

The earliest option that I am aware of is to attend an interview at a US consulate in my home country and get a new I94. But this is very expensive process for us (around $2500). Can I sue the attorney for travel expenses to get a new I94?

You should be able to get some help by making an INFO PASS appt in Atlanta with USCIS. See the USCIS web site to make the appt. You might try the USCIS info line & ask for a supervisor to get further info.

Probably not much chance of getting money out of the lawyer. They are experts at collecting not paying.

umm really sorry if this is the wrong thread to post in..but i want info about the h4 visa. what all it takes to prepare for it.its for a spouse who is on a work visa in the US rite?? its for one of my friends who needs it..ill appreciate the help..thanks in advance..

Actually, another way is to attend interview @ Montreal for which you can easily get (for lots less than $2.5K):
  • Canadian visitor visas for yourself and wife
  • 2 return-trip airtickets, ATL-YUL
  • hotel-room

As far as the lawsuit, you certainly can file one (for which I, having been shafted by a chop###k lawyer's misfiling me as EB-3 instead of EB-2, would be quite sympathetic)--but as to whether you will get any moneys back, different-hued horse entirely.
