My Boyfriend is from the Philippines. We are seriously considering withdrawing our k1 visa because I do not make enough, and have a co sponsor. Manila rarely accepts co sponsors. This is utterly heartbreaking for us. Last year, my BF received a b2 ten year multiple entry visa. If I cancel the k1 process, and he comes to visit me next month will there be a problem? I want him to stay with me for like 4 months, then we can go back together and get married and filed the K3. Any help or suggestions would be great.

You will be filing a CR-1 not a K-3.

K-3 is no longer processed at the NVC the I-129F is matched up to the I-130 and then it is closed. The CR-1 is then continued. Save yourself some time and just file the CR-1 instead after you are married.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

You will be filing a CR-1 not a K-3.

K-3 is no longer processed at the NVC the I-129F is matched up to the I-130 and then it is closed. The CR-1 is then continued. Save yourself some time and just file the CR-1 instead after you are married.

Ok Thanks, So I Would Be Filing the CR-1 & Would It Be A Problem if he visited me on the b2 after we cancel the k1?

He will need proof of ties to his country like job expecting him back, a home/ appartment, utilitys, school to return to etc. Might have trouble entering without proof of returning home but thats the same for most people.

No matter how you do it you will need to show that you have sufficient finances for the visa.

If the K-1 visa is approved...the other visa will no longer be valid...this is very important considering there is no guarantee another tourist visa will be issued.

When he visits me, is it ok to start the CR1 process while he is here? Say we got married in america but did not want to AOS. Is that ok? So when he goes back home, we don't have to wait long for anything.

You are welcome to visit marry and start CR-1 in the USA and he can return home at the end of his visa to attend the interview, etc. in his home country.

You are welcome to visit marry and start CR-1 in the USA and he can return home at the end of his visa to attend the interview, etc. in his home country.

As far as I know yes. I have heard of others doing the same thing with success, and there is nothing illegal about it.

Yes. With a CR-1 the I-864 is presented to NVC and they allow co-sponsors. Also, if a person does not meet the guidelines without a co-sponsor I am guessing that they will want their SO to work in the US as soon as possible. The K-1 is useless for that.

And BTW, there are NO visas for boyfriends. So do not let your fiance hear about the boyfriend.

Yes. You can get married and you can file for the CR-1 before he returns. Make sure he does not overstay his visit

Can you think outside of the box? Your primary complaint was not being able to make enough to qualify by yourself during the I-134 submission process; poverty guidelines. I have an idea for you which will allow you to make three times the poverty levels. I am talking about getting started in the trucking industry. Thousnad of ladies drive trucks for a living. It is good paying and stable. If you like go to Bubbajunk.com and survey companies that are hiring. Some will train you and you will pay them back over time for that training. Starting pay will be around 35-45,000. It is only an idea that will be a slam-dunk when you fill out your I-134. Plus, when your fiance has been licensed for a minimum of one year he can drive right along with you. By that time, your income will be over $100,000 combined. Can't beat that!!

You can not afford the K1.

But can afford a 4 month vacation....

Something does not add up.
